Biography

John was born about 1656 in Lower Norfolk County, Virginia Colony. His parents were John Herbert and Mary Bennett. John's father was a mariner. John lived on the plantation of his father in Lower Norfolk County.

His father, John Herbert alias Wilkinson, made his will in 1669 in Lower Norfolk County.

15 Jan 1669 - in the will of John Herbert alias Wilkinson he leaves his land to be equally divided between his sonne John and "ye rest of my wife's sonnes." To be delivered at the age of 21 years, "If that child my wife now goes with bee a boy, then his share to equal all the rest." "If any of the aforesaid children shall dye before they attayn to the age aforesaid or without heirs, his or their part to returne to those that survive." "1/3 of Personal & real estate to well beloved wife, Mary Herbert, during her natural life or marriage." "The other 2/3s to be divided between all my wife's children that is now living". ,„ — ~ (E 185a LNc)

John's wife Hannah Horne had been married to Abel Flewellen prior and had three children.

These children were Edward, Richard, and Mary.

Lower Norfolk County, Virginia Deed book 4 and page 22. 15 Aug 1677. 1677 - John Herbert's sons-in-law (step sons) Richard Flewellen, Edward Flewellen, and (step-dau) Mary Flewellen to receive certain cattle etc. at age of 16, Mary to receive hers at age 16. (Nco 4DB22a)

Note that the name of these children is clearly spelled with an F as in Flewellen. Although the record indicates that these were his sons in law and daughter in law they were actually the children of his wife from her former marriage and where John's step children.

Notes made by author and researcher Alice Granberry in her genealogy work on the Herbert family of England and Virginia.

(Note: The following deeds, although partially missing, further substantiate the relationships. Enough of the original records are left to indicate that the boundaries, laid out in the division of land in 1682, or by JOHN HERBERTS 1669 will, are being corrected to their own satisfaction. AGW)

John had a brother, Richard, who was born about 1670 in Lower Norfolk County.

John's father died in about 1675.

John made his will in Lower Norfolk County in May of 1679.

Family

John was married to Joanna or Hannah Horne in Lower Norfolk County about 1675. Their known children were:

  1. John b. 1677
  2. Thomas b. after 1679

John Herbert Jr. made his will in Lower Norfolk County, Virginia in May of 1679. Book 4 and page 50a https://www.familysearch.org/ark:/61903/3:1:3QS7-99PX-6DB?i=80&cat=370289The will indicates John Herbert Jr.

In his will John Herbert leaves his land to sonne John and if the child in esse be a boy then he is to have the other half.

the child in esse mentioned in his will was Thomas Herbert born after his father's death. John empowers his brother (1/2 bro.) Thomas Willoughby to see that his children are not wronged. (4 DB 50a LNc) [1]

Will processed 21 May 1679 by Francis Lake & Henry Dale. He leaves his estate to his wife . He named his son John & a child in esse (Thomas Herbert). His brother (1/2 brother) Thomas Willoughby to see that his children are not wronged. If all should die he leaves estate to his step sons Richard and Edward Llewellin.

JOHN HERBERT II is deceased and his children are living with HENRY DALE. The division was made according to the will of JOHN HERBERT alias Wilkinson :
1/3 to the orphans of JOHN HERBERT II son & heire of JOHN SR. both deceased, now living with HENRY DALE.
1/3 to RICHARD HERBERT (the child in esse in 1669)
1/3 to THOMAS WILLOUGHBY (this is the record with the will that proves his parentage.) [2]

Research Notes

Where was the land that his plantation was on in Lower Norfolk County?

Note

Suggest the wife was Johanna Mortene, goddaughter named in Johanna Yate's will. The Johanna or Hanna Horne was an underage orphan in 1662, and the first Llewelyn child, Edward, was born n 1662, meaning she could not have been the married mother. Which in turn means she is not the one that married Herbert.

DNA Connections
It may be possible to confirm family relationships with John by comparing test results with other carriers of his Y-chromosome or his mother's mitochondrial DNA. However, there are no known yDNA or mtDNA test-takers in his direct paternal or maternal line. It is likely that these autosomal DNA test-takers will share some percentage of DNA with John:
