THIS INDENTURE made the 27th day of July in the year of our Lord one thousand seven hundred and forty one Between JAMES SCOT of Overwharton Parish in STAFFORD COUNTY of one part and EZEKIEL JENKINS of Prince William County Truro Parish Planter of other part Witnesseth that said JAMES SCOT for Rents & Covenants herein after mentioned on behalf of the said EZEKIEL JENKINS to be paid & performed bath granted to farm let unto the said EZEKIEL JENKINS one Plantation & tract of land whereon he now dwells containing one hundred & fifty acres being part of a greater tract of land belonging to the said JAMES SCOT & is bounded beginning at a red Oak standing on one hundred & sixty poles distance from the beginning tree of the greater tract bearing North W. to a stooping red Oak thence South W. thence North East to the beginning together with all the houses & appurtenances thereunto belonging all mines minerals & quarries excepted To Have and to Hold the said tract of land of one hundred & fiftie acres as aforesaid unto the said EZEKIEL JENKINS during the space of the natural lives of the said EZEKIEL JENKINS, MARY his Wife and EZEKIEL his Son or the longest liver of them paying yearly unto said JAMES SCOT of the growth of the Plantation on the feast of St. Luke the Evangelist being the Eighteenth day of October the nett sum of Six hundred & thirty pounds of Tobacco according to Law and Cask to contain the same and if it shall happen the yearly rent be behind for the space of thirty days after said Eighteenth of October & no sufficient distress to be found then it shall be lawful' for said JAMES SCOT his heirs the above premises wholly to reenter & the same to have again and the said EZEKIEL JENKINS doth agree to plant an Orchard of one hundred good Winter Apple trees on some convenient part of the premises within three years of the date hereof at twenty seven feet distance every way at least & to keep the same well fenced in from harm of Catle or any other Creatures & to build good & convenient houses outhouses & Tobacco houses & to keep them in good repair & at the expiration of the above term to leave the said Tenement well fenced the houses & Orchards in good repair & the fruit trees well trimmed & fences in & fit for another Tenant to enter thereon and that no Subtenant shall be taken by said EZEKIEL JENKINS nor suffered to live on any part thereof under the penaltie of said EZEKIEL JENKINS his heirs their paying to said JAMES SCOT the sum of six hundred and thirty pounds of tobacco according to Law yearly during such Subtenants abode thereon over and above the yearly rent reserving a full liberty to the said JAMES SCOT at their will and discretion to grant Leave to his or their Tenants to take for building & Coopers Timber Carpenter Timber from the demised premises nor shall any trees fit for Carpenters or Coopers Timber or for Rails be cut down & suffered to rot and perish but made use of for the benefit of the plantation. In Witness whereof both parties have set their hands & Seals JAMES SCOTT EZEKL. JENKINS At a Court held for Prince William County the 27th day of July 1741 JAMES SCOTT acknowledged this Lease to EZEKIEL JENKINS to be his act & deed & it was thereupon admitted to record
