Breach of the Early Closing Act. -In the Summons Division of the Water Police Court yesterday. Inspector Bonarius proceeded against William Henry Keene, of King-street, for a breach of the Early Closing Act, to wit, employing an assistant for more than 60 hours during the week. Defendant was.lined 10s, and 7s 4d costs.

14 Mar 1903. Note: KENSIT v. KENSIT. Mr. Boyce, instructed by Messrs. Kershaw, Matthews, and Lane, appeared for the petitioner, William Henry Kensit ; the respondent, Eliza Jane Kensit, formerly Shaw, and the co-respondent, Frederick Jacobson, did not appear. The petitioner in this suit sought a divorce on the ground of adultery. The marriage took place at Fitzroy, Vic- toria, in November, 1890, the Rev. N. Kinsman being the officiating minister, and the rites those of the Free Church of England. Petitioner said in his evidence that he had taken the name of Keene for business purposes. Evidence was given in support of the petition. His Honor found the issues as to adultery in favour of the petitioner, but deferred pronouncing a decree until a copy of the certificate of the Government Statistician of Victoria was produced.

WHEN THE LIGHTS WERE LOW. William Henry Kensit, commonly known as Keene, a confectioner, of King-street petitioned for a dissolution of his marriage with Eliza Jane Kensit, formerly Shaw, on the ground of her adultery with Frederick Jacobson, who was joined as co-respondent. Petitioner, who was represented by Mr. Boyc'e,. deposed to having married the respondent in November, 1890, at Melbourne, according to the rites of the Free Church of England. In September last year he went to Woy Woy for a holiday, and after his return, from something he had been told he spoke to his wife. He told her that she had been carrying on with Jacobson while he was away, and that she would have to clear out. She. denied that she had been carrying on with any man. Rebecca Carroll, a married woman, and an employee of the petitioner, gave evidence to the effect that while Mr. Kensit was away at Woy Woy she and another girl remained at the shop with Mrs. Kensit on alternate nights. On one occasion Jacobson and the respondent went out together, and at another time witness booked a couple of seats for Mrs. Kensit at the Tivoli. She and Mrs. Kensit used to occupy the same bedroom. One night the respondent. entered the room, and took off a portion of her clothing. She then said she was going to the shop to count the money, and went downstairs. After a time witness heard whispering, and went to the top of the stairs. She saw that the lights were turned low, and slie heard Mrs. Keene's. voice and a male voice. Ethel Riley deposed to being in the employ of the petitioner. One Sunday in October Mrs Kensit told her that she had been out driving with her brother. On the following day Jacobson was in the shop, but he didn't stay very long. Jacobson was also there on the Tuesday, and just before he came Mrs. Kensit went up stairs, saying that if anyone except Jacobson called to say she was out. When Jacobson arrived he went upstairs. The petitioner was away at Woy Woy for about a month or six weeks, and during that time Jacobson was at the shop frequently. She had never seen him at the shop when the petitioner was at home. Florence Henley, a single woman and a sister of the witness Carroll, was in the petitioner's shop the night Mrs. Kensit was served with the divorce papers. The respondent said "she had been cunning, but wasn't cunning enough." His Honour found In favour of the petitioner, but deferred pronouncing a decree until the registrar's certificate was produced.

DISTRICT COURT. (Before Judge Rogers.). ALLEGED SLANDER. Fanning v Keene. Mr. Bignold, Instructed by Mr. H. Levien appoarod for the plaintiff, Rose Fanning; and Mr. Mocatta, instructed by Mr. W. H. Gray, for the defendant, William Henry Keene, confectioner, of 120 King-street. The plaintiff claimed ¹200 damages for alleged slander. The words alleged to have boon uttered wore: "I'll summons you for taking things out of my shop and giving them to your mother." The defendant denied using the words complained of, and pleaded that whatever words wore used wore provoked by the language and I conduct of the plaintiff; and that the words I wore used on an occasion when plaintiff's character was not likely to be injured Plaintiff had been employed by defendant for 10 months, and left on the night of May 5, when the incident occurred. His Honor entered a verdict for the defendant.

It was a term of tho contract that on com-. pletion of the work, and, after the production. by plaintiff of a certificate in the writing of. the defondant that the wholo of the work had. been duly done and completed to his satis-. faction, he would pay the Amount agreed upon. Tho contract was carried out, but defondant. had neglected and refused to give plaintiff. the certificate. In his fifth plea defendant. pleaded that it was a term of the contract that. Plaintiff should produce a certificate signed by. him (defendant), that the whole of the work. had been completed to his satisfaction, and. he did not produce It. To this plea plain-. tiff demurred on the ground that he was. excused and discharged from the obligation. to produce the certificate, and that, though. frequently requested to give tho certificate,. defendant had not done so. Sydney, in which the plaintiff claimed ¹1000. damages, for alleged slander. The plaintiff's. evidence was to the effect that in July last. year at the defendant's request, he assisted. him to prepare and furnish income tax re-. turns, demanded by the Federal Taxation. Commissioner, for the preceding three years. on an agreement that he (plaintiff) was to. receive ¹10 when the three returns were. made out and lodged and further sums If the. defendant was not penalised beyond ¹30, Jn. respect of late returns. In August after. the work is completed defendant paid him. ¹5, and told bim ho would give him some. further little amounts later on. Plaintiff. made application on different occasions but. had never been paid the balance promised. William Henry Keene, of Oxford-street, Sydney, wns also proceeded against for falling to pay a girl of 14 years to control a lift which carried passengers the minimum wage of ¹11711. It was stated that the girl received only ¹1 a week. Defendant, who pleaded guilty, said he was unaware that the girl came under the classification of lift attendant, as the lift was worked automatically. When the breach was pointed out to him he paid the girl all back money owing to her. The magistrate made an order similar to that In the preceding case.

At Central Court yesterday, William Henry Keene, junior, chartered accountant, was acquitted of a charge of having assaulted his father, William Henry Keene, retired business proprietor and property owner. A charge that, Keene, senior, had assaulted his wife, Ada Millicent Keene, was also dismissed.

Reserved judgment was delivered in the suit instituted by Quoug Wing, Dang Loon, Daug Charlie Doon, Charles Lum, and Stanley Hack, againnst William Henry Kensit, in which the plaintiff asked for an injunction res- training defendant, during the term of a cer- tain lease, from letting promises at 754-756 George-street, Sydney, or dealing with them in any way prejudicial to them, and from further proceeding with an action at common law to eject them from the premises. His Honor said that the defendant, who was, the registered proprietor; under the pro- visions of the Real Property Act, of the city premises above-mentioned, leased them to one, Stanley Willium Horne, for a period of six years, from Juno 5, 1919. Horne coven- anted not to assign without the defendant's leaveiIn writing, but it was provided that such leave should not be withheld in the case of respectable and responsible persons approved of by the defendant. On March 10, 1920, Horne signed a memorandum of transfer to the plaintiffs, but the defendant refused to con- sent to the assignment. Notwithstanding that, the plaintiffs went into possession of the premises, and the defendant afterwards. began an action to eject them. He also adver- tised the premises as being to let. Plaintiffs thereupon instituted these proceedlngs, ask- ing for an injunction and for damages. When the suit came on to be heard. Mr. Loxton (senior counsel for the defendant) demurred to the statement of claim, on the ground of want of equity, but he afterwards withdrew his demurrer on an understanding that Judg- ment should be entered in the action of ejectment, but should not be enforced, pend- ing the final determination of the equity suit. The substantial grounds of defence were that the defendant's consent to the assigument was not asked for before the transfer was sub- mitted to him for signature, and that, before he knew of the proposed assignment to the plaintiffs he had agreed with Horne to ac- cept a surrender of the lease. After re- viewing the evidence, his Honor held that the origin of the proposed assignees, who were Chinese, did not afford a justifiable ground for refusing to accept them as ten- ants: and that the other ground relied upon by the defendant (that the valuo of the pro- perty -would be depreciated if it were let to Chinese, was too wide to be accepted as a sufficient reason for witholding ap- proval. He thought, therefore, that the plain- tiffs were eutitled to the injunction asked for, and also to the inquiry as to damages, if they pressed for it. The defendant must pay the costs up to, and including the de- cree, which, by content, was to date from August 2: further consideration and costs to be reserved. His Honor further held that the defendant was not justified in withhold- ing his consent to the assignment of the lease to the plaintiffs. Mr. Maughan. K.C., and Mr. H. H. Evidence was given in support of the petition. His Honor found the issues as to adultery in favour of the petitioner, but deferred pronouncing a decree until a copy of the certificate of tho Government Statistician of Victoria was produced.
