Samuel Magness was a Virginia colonist.

Samuel Magness, son of Peregrine Magness and Mary Naylor was born about 1761 in Frederick County, Virginia. He passed away about 1831 in Marion County, Arkansas.

Samuel and family are included on the 1790 US Federal Census, Greenville, South Carolina. In his household:[1]

  • Males 16+ - 1 [Samuel]
  • Males under 16 - 1 [son, David ?]
  • Females - 3 [wife Mary & 2 daughters]

On 3 May 1792 Samuel had a land transaction recorded in Greenville County Deed Book C, page 436. On 19 December 1817 he sold his share of the estate of brother William Magness to his brother-in-law, John Roberts, for $625. This sale was recognized in the settlement of William's estate in 1825. William is thought to have moved to Arkansas about 1838. On 15 August 1829 he made a deed as Samuel Magness of the Territory of Arkansas, County of Independence.[2]

Samuel continued to live in Greenville, South Carolina, until about 1828. He is listed on census records there in 1800, 1810 and 1820. In 1830 Samuel is on the census in Black River, Independence, Arkansas Territory. He then moved to Marion County, Arkansas, where he died in 1831. His wife Nancy died there about 1841.

Estate: 1819 Lawsuit

Samuel's brother, William Magness, died on 6 May 1816, without leaving a will and without issue. Because there was much litigation, the estate was not settled until 1825 and was then divided among the seven siblings of William or their heirs. Samuel was one of the plaintiffs in the lawsuit.

On 25 Feb 1825, Commissioners appointed by Lincoln County Superior Court: Maxwell Wilson, Wm. J. Wilson, Wm. Oates, Lemuel Moore, divided Real Estate property being surveyed by Maxwell Wilson among the Petitioners and Heirs of Wm. Magness, dec'd: Lot No. 4, to John Roberts, assignee of Samuel Magness, one of the Petitioners, land where Roberts now lives on main Buffalo Creek in Lincoln County; ... Real Estate Divisions presented to Lincoln County, NC, Superior Court April Term, 1825..[3]

Marriages & Children

Samuel married twice, first to Mary Morgan about 1784 in North Carolina, either Tryon or Rutherford County. Samuel married a second time by 1800 to Nancy Ragin in Greenville, South Carolina. No marriage records have yet been found. Samuel and Nancy Magness signed a deed on 22 January 1800, recorded in Greenville County, South Carolina (Deed Book E, Page 405).[4]

Research Notes

Incorrect Marriage

Samuel was not married to Ann Ware in 1779 in Prince George's County, Maryland. Samuel was born in Frederick County, Virginia, never lived in Maryland. By 1779 he was living with his parents in North Carolina. The marriage cited on this profile was for some other Samuel Mackness, not this one. Ann Ware should be unlinked as wife.[5]
