Note NI756His ancestry is speculative. Most researchers believe he was a son William and Ann (Peyton) Mallory, and that he was named for her father Timothy Peyton. Others point to his calculated date of birth (17 January 1783), which was ten years before their 1793 marriage. It seems likely he was closely related to the other Mallorys in Harrison County, Kentucky. 1

22-23 January 1813 Frenchtown, Michigan: While attempting to re-take Detroit, members of Capt. Richard Hightower's Company 17th U.S. Infantry were captured by Patawatomies and held with Maj. Benjamin Franklin Graves, John Davenport and Samuel Ganoe. Mallory escaped with Ganoe per Ensign Isaac L. Baker's 25 February 1813 report to General Winchester. (Turner, «i»Graves County Kentucky History & Families«/i» (2001), 15 (summarized)). Some researchers identify Mallory with this Timothy Mallory. 1

He married Martha Jackson in 1816 at Harrison County, Kentucky. He appears as Timothy Mallery on the 1820 census there on the east side of the south fork of the Licking River. His household consisted of 2 males 16-26 (himself and one other, probably his brother John Mallory), 1 female 16-26 (wife Martha), 1 male under 10 (son John), and 1 female under 10 (daughter Jane). The identification of the other male as his brother John is supported by their proximity to James Brownfield, who became John's father-in-law. 1 served as a Private in the 5th Regiment of Kentucky Militia, earning per year, roll dated 10 October 1823. 1 moved to Jefferson County, Indiana before 1830. 1 appears on the 1830 census as Timothy Mallary in Lancaster Township, Jefferson County. His household consisted of 1 male 30-40 (himself), 1 female 20-30 (wife Martha), 1 male 10-15 (son John), 1 female 10-15 (daughter Nancy), 1 male 5-10 (son Timothy), 1 female 5-10 (daughter Malinda), 2 males under 5 (sons Jonathan and William), and 1 female under 5 (daughter Margaret). 1 appears on the 1840 census as Timothy Malory in Madison Township, Jefferson County. His household consisted of 1 male 50-60 (himself), 1 female 30-40 (wife Martha), 1 female 20-30 (daughter Jane), 1 female 15-20 (daughter Malinda or Nancy), 3 males 10-15 (sons Jonathan, William, and one other), 1 female 10-15 (daughter Margaret), 2 females 5-10 (unknown), and 1 female under 5 (unknown). 1

In 1850 Timothy and his wife were living apart. Timothy himself appears on the 1850 census as Timothy Malera (65), a butcher, at Madison City in the household of (his son-in-law) John G. Kriel (35), also a butcher. Timothy's son William (23), a butcher, was living next door. His wife Martha was living separately in Madison City. 1

His burial record says he died 29 October 1867, age 84 years 9 months 12 days, and notes that he was a Veteran of the War of 1812.
