Soldier John Nichols Sr. served with 6th Virginia Regiment (1776), Continental Army during the American Revolution.

John Nichols Sr. is a DAR Patriot Ancestor, A083505.

John Nichols Sr. was a Virginia colonist.

1st Lt. John Nichols was a Revolutionary Soldier, surveyor and carpenter. Born in Maryland to Thomas Nichols and Ann Davis, he is a direct descendant of Simon Nicholls, the immigrant and town crier. He is the father of Captain John P. Nichols and Senator Flayle Nichols of Tennessee.

JOHN NICHOLS was born on January 21, 1720, in Frederick, Maryland, to THOMAS NICHOLLS and ANN DAVIS. He married MARTHA J PAYNE in 1747 in Virginia, the daughter of FLAYLE PAYNE. They had eight children during their marriage. He died on December 26, 1803, having lived a long life of 83 years. He was a farmer, a surveyor and a patriot.

John was a first lieutenant under Captain Henry Butler in the Maryland militia according to the deposition of his son Captain John Nichols....

At the request of John Nicholls the following Deed was Recorded October the 2d 1775 to wit, This Indenture made this twenty second Day of September in the Year of our Lord one thousand seven hundred and seventy five Between John Garrett of Frederick County and Province of Maryland farmer of the one part and John Nichols of the same place farmer of the other part Witnesseth that the said John Garrett for and in consideration of the sum of sixty one pounds to him in hand paid by the said John Nicholls . . . part of Lott Number Twenty two being part of a Tract or parcel of Land scituate lying and being in Frederick County and Province of Maryland aforesaid called and known by the name of the Resurvey on Merryland Beginning at the end of sixty eight perches on the seventh Course of said Resurvey on Merryland and running thence by and with the out lines thereof the two following Courses South fifty nine Degrees West seventy two perches South eighty Degrees West forty perches then North one hundred and eleven perches to the end of forty two perches on the tenth Course of said Resurvey on Merryland then by and with said tenth Course North sixty six Degrees East thirty eight perches then by a straight line to the beginning containing fifty Acres and one half Acre of Land more of less . . .

Note about the parents of Nichols-3175

James Nichols believes McComb-261 and Nickell-2 were the parents of Nichols-3175. According to evidence gleaned from his mother's book, The Final Irony. ^[1] "Nickell-2 was born around 1700 in Ireland and was the Nichols to come across the pond. I'm not sure where she got the birthdate. In Chalkleys vol 3, page 563 there is an entry "373 Page 427.— 18th August, 1760. John ( ) Nicolas (Nickle) and Barb- ra ( ) to his son John Nicolas, £5, 250 acres on Moffett's Branch of Middle River, part of 400 acres patented to William King, 10th February, 1748, and conveyed to said Nicolas. Delivered : John Nickel, February, 1767." So he may not be writer of the 1774 will??? Still looking."

^[2]State of Virginia } On this 24 day of July one thousand eight hundred and forty-five personally Bedford County } appeared before the subscriber a Justice of the peace in and for said County Captain John Nichols aged about Eighty four, and who I hereby certify to be a respectable citizen of the county aforesaid, entitled to credibility who first being sworn according to law deposes and says That he was a citizen of Washington County Maryland prior to the fall of 1799 that he then and there was acquainted with Patrick Lynch, That the said Patrick Lynch entered the service of his country in the revolutionary struggle as a souldier of Malitia under the command of Capt. Henry Butler and was marched into service at Fredericktown Maryland in company with this deponents father John Nichols Sr. (who was the first Lieutenant of Capt Butler) in the winter of 1777, that this deponant well recollects this fact; from the circumstance of his haveing accompanied his father, Lynch and others, for the purpose of bringing back the horses they rode to join their company That the s’d Lynch served out his tour of three months as this deponant has heard from his father, and believes, when he returned. This deponant with his father and family moved from Maryland to the County of Bedford Virginia where he now resides in the month of September 1779, that in the month of October or November following the said Patrick Lynch came into the said County of Bedford Va, in company with and driving a team for Frayl Payne, and settled within a short distance (2½ miles) of this deponant. that he remained in the employment of the said Frayl Payne untill the summer of the year following (1780) when he the said Patrick Lynch, again entered the service of his country as a substitute for John Beuford [probably John Buford] for a tour of three months, that this deponant from what he has heard the said Lynch say since the war believes that he served out the tour for which he had substituted, when he again became a substitute for some other person and served another tour of three months; at any event this deponant knows he was absent from his home some near eight months before he returned, and when he did return he brought with him two horses, which he said was given him in pay for substituting. This deponant further states that the said Lynch did not remain at home any length of time before he again took his own tour of duty, and this deponant believes served untill the surrender of Conwallis at Yorktown, when he was discharged & returned home. This deponant does not know under what officers Lynch served as he was detailed & substituted for others. That a portion of his service was in S Carolina but does not recollect of haveing heard under what captain. This deponant further states that after the return of the said Lynch from the wars, he remained in the neighbourhood untill the time of his marriage which this deponant was at; and which was solemnized at New London in the County of Bedford by a minister of protestant church by the name of John Holt That he was then and there married to Patsey Whirley with whom he lived untill the time of his death which took place in the county aforesaid at his residence on Staunton in the Spring of 1832 or 1833. That his widow the said Patsey survived him and remained a widow to the time of her death which took place on the 9th day of March 1843. This deponant will not be positive as to the year in which the said Lynch was married, but believes it took place the fall of the year after the surrender of Conwallis at Yorktown. at any event he knows it to have taken place prior to the 1st day of January 1794, as this deponant was himself married in the fall of 1784, and he well knows that the said Lynch was married prior to that time. and further this deponant sayeth not. " In the Name of God Amen I John Nichols Sen. of Bedford County in the State of Virginia being low in health and weak in body but of perfect mind & memory, thanks to Almighty God, but knowing it is allotted for mortal man to die, I do make and ordain this to be my last Will and Testament, first recommending my poor Soul into the hands of the almighty God that gave it to me and my poor body to decently to interred and after my lawful Debts and funeral expenses is discharged, I will and bequeath my Worldly Estate that it hath pleased the Almight God to possess me with, in form and manner following, Viz Item, I bequeath unto my son Flayl Nichols my big family Bible. Item , I bequeath to my son John Nichols, my young horse called Ceilia, after my beloved wife, Martha, decease. Item; I bequeath unto my son Archibald Nichols, a tract or parcel of land beginning at a locus near the fence of premises now tending, thence a new marked line down to the mouth of ny lane, thence along the old line to Gills and my corner tree to a spanish Oak, thence along as the old line directs to a chestnut or Burnetts line, thence along Burnetts line to a newmade corner white Oak on Elisha Nichols line thence along Elisha's new line to the first station. Item; I bequeath unto my son Elisha Nichols a tract of land or parcel of land, beginning at a chestnut on Ayer's road thence along the road as the new mark line goes to a pealed corner white oak , thence off across the field and as the newmarked line goes to a corner white oak on Burnetts line including the twelve Acres I purchased of Elisha Burnett, thence along the line to the beginning station. Item ; I bequeath unto my son Jesse Nichols, the tract or parcel of land whereon I now dwell after my beloved wife Martha Nichols (decease) Beginning at Pointers next to John Hall's line, thence along as the line directs to a corner chestnut on Ayers road thence along the road a new lineto the corner pealed white oak in the field, thence along off across the field and along Elisha's new mark't line to the new mark't corner locus by the fence, thence along the new mark't line to the mouth of the lane, then along as the old line directs to Gill's and my corner Spanish Oak. Item ; I bequeath to my beloved wife Martha Nichols, the negroe Wench name Delphia and negroe boy named Frank, during her life or widowhood, after that to be equally divided between by my two sons Elisha and Jesse Nichols. Item; I bequeath unto my sons Elisha and Jesse Nichols the waggon, three horses, named Dick, Jack and Sawny, and all the utensils belonging to the waggon. Item ; I bequeath unto my son Elisha one red and white spotted no horn Heifer. Item ; I bequeath unto my son Jesse Nichols one dark brinded Heifer. Item; I bequeath unto my children Mary Cundiff, John Nichols, Katherine Pollard, my son Archibald Nichols, and my daughter Jane Hancock, all the other moveable property of my Estate after my beloved wife Martha Nichols deceases excepting what is before mentioned and a small shott gun, which I bequeath unto my grandson John Nichols, the son of my son John Nichols., Item; I do constitute and ordain my two beloved sons Elisha Nichols and Jesse Nichols my sole Executors to this my last Will & Testament revoking and disannulling any other former Will & Testament and constituting and allowing this to be the last Will & Testant according to my desire; Given under my hand and seal this 5th day of April 1803.
