John Shumate was a grandson of a Huguenot emigrant (1540-1790).

John left a will and named his wife and children. (Fauquier Co. WB 2, p. 47-48 )

Fauquier County, Virginia Will Book 6 pages 38-41 In the Name of God Amen. I, John Shumate Senior of the County of Fauquier and the Commonwealth of Virginia, being weak of body, but of disposing mind and memory, thanks be to God do make and ordain this my last Will and Testament; hereby revoking and making void all former wills and testaments.

Imprimis. My will and desire is that all my just debts shall be paid by my Executors hereafter named as soon after my death as it may be convenient.

Item. I give and bequeath to my beloved wife Susannah during her natural life (in lieu of her Dower in My estate) the following slaves, Viz: Dick, Jack, Cyrus, Alley, Lucy and Grace with their future increase; the plantation whereon I formerly lived for many years; also the plantation utencils (sic); stock of every kind & household kitchen furniture.

Item. After the death of my Wife it is further my will and desire that all the property which I have heretofore given to my Wife Susannah, that is to say, Land, Negroes, Stock, #c be sold and equally divided between my daughter Susannah Evins her heirs, &c. The present and future Children of my daughter Elizabeth Bronaugh, the present and future children of my daughter Sarah Manifee (Menifee) and the present and future children of my son Armistead, lawfully begotten of his body, that is to say to be divided in four equal parts.

Item. I give and bequeath to my Brother Thomas Shumate all the land I held from Elk-Run to Mussel- run on the North side of the road leading from Elk-Run to Dumfries.

Item. I give and bequeath to Jane Shumate, the Widow of my son John Shumate Deceased. The following Negroes namely Abraham, Adam and Hannah; also my land at Elk-run lying on the South side of the road leading from thence to Dumfries including the Tavern and all other buildings appertaining thereto for and during her natural life. And after her deceased it is my will and desire that the Land and Negroes devised to Jane Shumate for and during her life only shall be equally divided between my two Grand Children Arthur and Jane, the Heirs of my son John, deceased to them and their heirs forever.

Item. I give and bequeath to my Grand Daughter Eliza, daughter of my Son Berryman, one hundred dollars to be paid to the out of the sales of my Estate after the deceased of my wife which sum is to be paid to her by my Executors, Administrators, &c.

John was born in 1740. He passed away in 1814.
