Biography

Daniel was born December 23, 1777 in Orange County, North Carolina. He was the son of Benjamin Stone and Sarah Lewis. He passed away about 2 August 1857 in Warren County, Kentucky and is buried in Mount Olivet Cumberland Presbyterian Cemetery, Warren County, Kentucky.[1] Note: most family trees use 1771 as birth year. Gravestone has 1777; no other birth record found as yet.

Daniel married third Elizabeth Fox 10 June 1807.[8] Both Daniel and Elizabeth Fox are listed on the death record of their daughter Ann Arabella (Stone) Hines who passed away in 1916 in Warren County, Kentucky.[9]

Death

The will of Daniel Stone was written 8 December 1856 and probated at the August term 1857 Warren County Court. The assumption is that he died in July or August 1857.[10]

In the name of God Amen. I Daniel Stone being in sound mind but feeble in body and calling to mind that it is appointed for all men to die do constitute & make this my last Will & Testament hereby recinding and revoking all others.

Item First. I wish all my just debts to be paid. I give and bequeath to the heirs of Susan Jenkins’s body my dauter one equal child’s portion of my estate subject to a deduction of two hundred dollars she having received that amount heretofor to be equally divided among her children as they become of age.
I give and bequeath to the children of my deceased son Benjamin H Stone one equal portion of my estate charging them in the distribution of my estate with two hundred dollars advanced their father in his lifetime.
I give & bequeath to my daughter Aphire C. Hamil one equal child’s portion of my estate subject to a deduction of ninety two dollars also to a deduction of Six hundred dollars for the tract of land she now lives on which sums I have given her heretofore.
I give and bequeath to my daughter America Jane Wheeler one equal child’s portion of my estate subject to a deduction of one hundred and seven dollars which sum I have given her heretofore.
I give & bequeath to the children of my deceased son William E Stone one equal portion of my estate charging them in the distribution of my estate with one hundred and forty dollars advanced their father in his lifetime.
I give and bequeath to my daughter Isabella Ann Hines one equal child’s portion of my estate subject to a deduction of ninety four dollars which sum I have given her heretofore.
I give and bequeath to the children of my decd. son Erasmus D. Stone one equal portion of my estate charging them in the distribution of my estate with four hundred dollars advanced of their father in his lifetime but the afd equal portion of my estate subject to the advancement aforesaid is upon condition that the children and heirs of said Erasmus D Stone shall not set up any claim to $500 purporting to be due and owing to said E. D. Stone for the sale and purchase of a Negro boy William as appears by a conveyance of record in the Warren County Court Clerk’s office of date eighth of July 1849 from the said E. D. Stone to me & here referred to used herein the most solemn act of my life declare that I have paid the said E. D. Stone every cent of said $500, for and on account of the purchase of said servant boy William & advanced to the said E. D. Stone the $400 in addition as here and absolutely charged to him. It is therefore my will and desire that if the children of the said E. D. Stone, or anyone for them should seek to recover of my estate the said $500 for & on account of the aforesaid boy William then and in that event said children of the said Erasmus D. Stone are to have no share or portion in the distribution of my estate & for the reason aforesaid.

I hereby nominate and appoint my son in law W. T. Wheeler executor of & to this my last Will and testament hereby again revoking all previous wills made by me. Signed and sealed this 8th day of December 1856.
