John F. lived in the Belltown Community where he died after a short illness which was attended by Dr. H. C. Ghent, of the practice Ghent & Shepherd, of Chulafinnee AL. He was living with his brother William T. in the 1850 Census of Benton Co., AL.
The following Will is on file in Calhoun County, AL along with additional papers of administration.
TURNER, John F. "In the name of God Amen. I, John F. Turner of the County of Benton and State of Alabama being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore ordain publish and declare this to be my last will and testament that is to say first after all my lawful debts are paid and discharged the residue of my estate real and personal, I give bequeath and dispose of as follows to wit: to my beloved wife the land and appurtenances situated thereon known and described as the Northwest quarter of the Northeast quarter of Section 31, in Township 14, of Range 10 and the Southeast quarter of the Northwest quarter of Section 31, Township 16, Range 10 in all containing 80 acres. East in the Coosa Land District and the whole of my personal estate owned or held by me at this time, consisting of household and kitchen furniture and stock included. The above described personal and real estate is to be held by my wife, Ferriby Turner, until my only child, William I. T. Turner shall have become twenty one years of age at which time such of the above described property and its increase to be equally divided between my wife, Ferriby Turner, and son, William I. T. Turner, and at the death of my wife my son is to fall heir to the whole of the foregoing property and its increase. Likewise, I make constitute and appoint my wife, Ferriby Turner, sole Executrix of this my Last Will and Testament, hereby revoking all former wills by me made. It is furthermore my request that she be not required to give security as executrix of this my last will and testament. In witness whereof I have hereunto subscribed my name and affixed my seal, this twenty ninth day of March in the year of our Lord one thousand eight hundred and fifty six." Signed: John F. The above written instrument was subscribed by the said John F. Turner in our presence and acknowledged by him to each of us and he at the same time published and declared the above instrument so subscribed to be his last will and testament and we at the testator's request and in his presence have signed our names as witnesses hereto, and written opposite our names our respective place of residence. Gent (Note: Martin Ellis, age 30, was a teacher of Music, owned $1,000 worth of personal property and $200 worth of Real Estate. He was born in AL, his wife was named Anna, aged 21, and son, Charles, age one, lived in Randolph Co., AL as of the 1860 Census. H. G. Ghent, age 28, was a physician, owned $1,200 worth of personal property and $2,000 worth of Real Estate. He was born in SC and lived in Randolph Co., AL as of the 1860 Census. W. T. Wood, Testator, age 34, was a farmer, owned $2,000 worth of personal property and $4,000 worth of real estate. He was born in GA and lived in Randolph Co., AL as of the 1860 Census. HE lived next door to Benjamin Striplin and the Higginbotham families in Chulafinnee, AL both well established families in the community. The Hoppers mentioned could not be found as of 1860.)(Could this have been Harper and not Hopper?)
The State of Alabama Benton County Personally appeared before me A. Woods Judge of the Court of Probate in and for said county and state F. M. Hopper one of the subscribing witnesses tot he foregoing instrument who being in open court deposed and saith upon his oath that John F. Turner signed, published and declared the foregoing instrument to be his last will and testament, that he signed and executed that same on the day and year it bears date, and was at the time of his death residing in Benton County, AL, and was of sound mind and memory and over the age of twenty one years that at the time the said Turner signed & executed said Will he called upon deponent & Martin Ellis, Isaac Hopper, W. T. Wood and H. C. Ghent to bear testimony of the same, and affiant states that himself and the said Isaac Hooper, Ellis, Wood, & Ghent all at the request & in the presence of the said Turner subscribed their names to the foregoing Last Will & Testament as attesting Witnesses and each one in the presence of the others on the day & year it bears date. The State of Alabama Benton County I, Alexander Woods, Judge of the Court of Probate in and for the county and State aforesaid do hereby certify that the within will was duly probated and admitted to record on the 24th day of May 1856 and that the same was duly recorded on the 3rd day of June AD 1856 in Book L on pages 319, 320, 321. April 5, 1856, Charge for one coffin for Male of Randolph Co., AL.
One debt to which John Turner had agreed to pay Matilda Thrower, his sister, $12.10 by Sept. 1, 1856. Loan made Feb.. 25, 1856.
Another expense was for a notice to creditors which ran in the Jacksonville Republican six times for a cost of $3.50 beginning June 3, 1856.
March 15, 1858. Final return by Ferriby Turner, Executrix of the estate of John F. Turner, deceased. Heirs and distributees given as: Fereby Turner, widow, William Isaac T. Turner, minor under 14 years.
