Research Notes

Chancery Court deposition by Susannah Porter

The Chancery Court case was brought in 1804 by an heir of Amos Allard and it involved a dispute over land that Amos Allard may have owned. The Amos Allard case was famous because Allard had been shot in 1786 for being a horse thief. Although a witness claimed that Susannah's son John Porter shot and killed Allard, it was her son Samuel Porter who was tried and acquitted of the murder.

The following deposition was given by Susannah Porter Washington County over a land dispute brought by the heirs of Amos Allard in Chancery Court:[3]

Susannah Porter of lawful age being duly sworn deposeth and saith. That she happened at the house of Amos Allord shortly after Allord had sold his land on Fall Creek to John W. Crunk and Mr. Allord and John W. Crunk desired this deponant to go in company with Mrs. Allord to Amos Allord and she did accordingly go and the writings was read and said Allord said he had sold his land to John W. Crunk and desired her to be a witness and she did make her mark, a cross, to testify the bond for the title and she thinks Benjamin Pendletons name was mentioned somehow respecting the making the title but in what respect she will not say as time has worn it out of her mind, but Benjamin Cooper was present and a witness to the title bond and the other writings then acknowledged by Allord. And then Allord gave the writings to Cooper for Crunk. Further this deponant saith that she heard or understood that Allord received two horses from Crunk in part of pay for the land. Sworn and subscribed before me this 3rd day of March 1804.
