James died 38 days after an accident that occurred on 28 October 1896. The Ballarat Star reported -
"A man named Westbrook was admitted to the Amherst Hospital on Wednesday from Lexton, where he had sustained a fracture of one thigh and other injuries from the kick of a horse. The fracture was of so serious a character that the broken bone lacerated the flesh, and before the sufferer could reach the hospital—a distance of 16 miles—he being driven in all haste to the institution, the loss of blood was so great that he was admitted in a state of collapse. The man is about 60 years of age, and his condition is considered critical."
