CSA, Co. C. 1st NC Artillery, (Batt C, Poague’s Battery Artillery; also known as Graham’s Battery) enlisted 26 Dec 1861 Lincoln Co, NC at Keever’s Store. Unit assigned to Army of N Va under Lee. Per muster rolls, deserted on march from Mitchell’s Station to Orange Court House 3 Aug 1863. Under arrest through Sept 1863; in Richmond, VA awaiting sentence of Grand Court Martial G. O. No. 100-1; per Tom Lowry email of 4 Feb 2013, In November 1863 he was convicted of desertion and given a year at hard labor. He was not shot because of "previous good character." From fold3 muster rolls: sentence remitted 7 Apr 1864. Mar/Apr 1864 back with unit, received back pay and commutations; 1865 absent 18 days furlough from Feb 25 by order of Gen. Lee. He appears on POW list surrendered by Gen. Lee to Gen Grant at Appamattox 9 Apr 1865.
John is buried in a family cemetery in cow pasture in Burke Co. according to Uncle Donald Propst ca 2000. Go up old 18, turn right on Will Hudson Rd. before Zion Hill; go 3.5 mi, just after Roger Hill Road and before intersection with Rhoney Rd. look to left behind a block building for cemetery in a grown up area. Also known as Tallant, Yancey AND Bradshaw Cemetery.

Possible reason for his not being buried at Zion Hill with wife (Benny Yancey’s dad); the river was up and the casket could not get over. After a few days, the body started decomposing and he was buried in the Tallant Cemetery.
