Oct. 16--Elmer McDonald of Ida, charged with participation in the flogging by a band of masked men June 5, 1922, of A. J. Akard, then postmaster of Ida, late Wednesday was found guilty by a jury in Federal court here. Sentence was deferred by Judge Franklin E. Kennamer. The conviction carries a sentence of not more than ten years or a fine of ,000, or both. Marvin McDonald, Lee Watson and Jess Walden, charged jointly with Elmer McDonald, were aquitted upon instructions of Judge Kennamer. According to court attaches this is the first instance of a flogging case tried in a Federal court. ------------------------------------------------ Syracuse Herald Sunday Morning, November 16, 1924 Third Section-3 ABUSED YOUTH ASKS ,000 FROM KU KLUX Muskogee Okla.. Nov. 15.—An echo of Malcolm Etheridge’s disappearance, a month's sensation in the Southwest three years ago, is now heard in the Oklahoma courts with the filing of a suit by Etheridge, a 20-year-old youth, against the Ku Klux Klan and 24 prominent citizens of Muskogee. Etheridge asks for ,000 damages on the ground that under threats and torments, he gave men, whom he charges were Klansmen, a confession that he had disappeared and maltreated himself to achieve notoriety. Following his alleged kidnapping and disappearance he was found July 1, 1921, bound and gagged under a pile of refuse in an abandoned warehouse in Muskogee. About the time Etheridge’s suit was instituted, the Klan figured in other court proceedings, before United State Judge Franklin E. Kennamer at Tulsa. Judge Kennamer was called on to sentence a member of a white robbed and masked gang that flogged a. government employe.(sic) Elmer McDonald was convicted of flogging A. J. Akard, Postmaster at Ida, Okla. Nine other men, were implicated by McDonald who, an old man was let off with six months in jail, 0 fine and a stern reprimand from the bench which scored (sic) not only the prisoner, but all "men who take the law into their own hands." Akard of Battiest Succumbs After Five Weeks Alvin J. Akard of Battiest, Okla., 50, injured five weeks ago in an automobile collision near Broken Bow, Okla., died at the Sanitarium of Paris Wednesday morning at 11:55 oclock. He was born October 8, 1888 in Lamar county, but had engaged in business as a merchant at Battiest a number of years. The funeral service was arranged for 2:30 oclock Thursday afternoon at Emberson-Brown-Roden funeral home, with burial at Evergreen cemetery. Surviving are his parents, Mr. and Mrs. Jake Akard of Battiest and three sisters and a brother; Mrs. Cora Williams, Finley, Okla., Mrs. Alta Kennemer of Bairdstown, Lamar County, and R. M. Akard and Mrs. Verda Parsons of Battiest. He was injured when his truck and a car driven by Mrs. F. B. West, McCurtain county public health nurse, collided September 28, near Broken Bow, Okla. Mrs. West, the former Miss Maud Herndon of Paris, seriously injured at the time, is still at the sanitarium but is reported resting well.
