The assistant attorney general has filed a motion to dismiss the appeal because of a defective recognizance, in that said recognizance fails to state punishment in accordance with article 887, Code Cr. Proc., as amended by the Acts of 1897. We have examined the recognizance, and in our opinion the same is defective, and has been so held since the decision in May v. State (Tex. Cr. App.) 49 S. W. 402. The appeal is accordingly dismissed.
