1807: from Deborah J Youskevitch 815-634-8028: A court action in Hardin Co, Ky: Peter W Smith versus William Lusk, Charles Ash, William Ash, Ignatius Strange, Phillip Strange and James Strange. Smith asks damages of $1000. Plaintiff’s lawyers were Hardin and Duvall. In 1807 Smith said the Defendants built a fish dam of stone and sticks across Rolling Fork knowing that he (Peter Smith) had a boat of produce loaded for Orleans and Natchez which was stranded and beat to pieces. Case was continued from time to time- finally a judgement was given against the Defendants who had failed to appear. In Jun 1810, Smith filed an amended declaration. Because of the size of the damages asked, a jury was summoned and the Plaintiff was awarded $500. William Ash came to court and asked that the case be reinstated because the Defendants were never notified. A new trial was granted and the jury found for the Defendants and the Plaintiff was ordered to pay all the Defendant’s costs.
