Genforum: According to Westmoreland Court records Francis had first wife Susan in 1718. Again from the same records he had second wife Sarah in 1740. What were their maiden names? I am from his second wife Sarah. Is she the same Sarah McCarty who married Thomas Beale IV?
From THE DULIN FAMILY IN AMERICA, Miscellaneous ATWELL OR ATTWELL: INDENTURE: Indenture of Francis Attwell Junr to Richard Kenner This Indenture made this thirteenth day of September Anno Domini one thousand seven hundred and eighteen and in the fourth year of the reign of our sovereign Lord George by the grace of God King of England Scotland France & Ireland defender of the faith & by & between Francis Attwell Junr & Susan his wife of the county of Westmoreland in the Colony of Virginia of the one part and Richard Kenner of the said county and colony of the other part. Now this Indenture Witnesseth that me said Francis Attwell Junr. & Susan my wife as well for & in consideration of ten thousand pounds of good Tabacco in hand received from the above Richard Kenner whereof & wherewith me the said Francis Attwell Junr & Susan my wife do acknowledge myself satisfied & paid have bargained sold aliened enforced & confirmed and by these presents do grant bargain sell aliened enforced & confirm unto the above said Richard Kenner of the County of Westmoreland of Virginia aforesaid all that tract & parcell of land I now live on containing two hundred & thirty acres more or less situate lying & being on the south side of loor machodack & between two branches comonly called & know by the name of the middle branch and the horse bridge branch which so land did formerly belong to old Thomas Attwell alis Collins together with all buildings orchards plantacons tenements rents priviledges comodities & damages whatsoever to the same belonging or in any ways appertaining according to the grants & pattents for the said land To have and to hold the same two hundred and thirty acres of land be it more or less together with all buildings orchards plantacon tenements rents & priviledges comodity & comoditys & damages whatsoever to the same belonging or in any ways appurtaining or which now is or at any time hereafter hath been or in any ways belonging moving being or any ways appertaining to him the said Richard Kenner his heirs Exs. Adms. or assignes he or they paying the yearly rent to the proprietor that shall become due for every year after this year and me the said Francis Attwell Junr & Susan my wife do by these presents farther oblige ourselves our heirs Exs. Adms. or ass?s do warrant bear harmless & keep & defend the said Richd Kenner his heirs Exs.Adms. or assigns from any person or persons whatever from by or under us or any of our heirs and from all other persons whatever and that we the said Francis Attwell Junr & Susan my wife do further covenant & agree to & with the said Richard Kenner his heirs & assigns that he the said Francis Attwell & Susan his wife have at the signing & sealing hereof a good & sufficient estate in fee of the said land & premises and that they have good right & lawfull authority to convey the same to the said Richard Kenner his heirs Exs. Adms. or assignes make sign seal & deliver such patents deed or deeds or conveyance or conveyances, assurance or assurances in law of the said land & premises as the said Richd Kenner his heirs & ass?s shall think fitt or his or their councill learned in the law shall advise devise or procure . In witness whereof me the said Francis Attwell & Susan my wife have hereunto sett our hand and seal the day & year above written - Francis Attwell Junr (Seal) Susan Attwell (Mark)(Seal) Signed sealed & delivered in the presence of William Sanford, Thomas Chandler (Mark) (illegible) thats on the 13th day of Sept 1718 Francis Attwell & Susan his wife did deliver to the within mentioned Richard Kenner possession of the within Land & premises by delivering turf? & twigg? & giving possession of the main mannour house in token of seizen? in presence of us William Sanford, Thomas Chandler (Mark) Francis Attwell Junr Susana Attwell (Mark)
At a court held for the said county the 24th day of September 1718 Francis Attwell Junr personally acknowledged the above instrument to be his proper act & Deed together with livery of seizin? thereof endorsed and John Aubrey by virtue of a power (duly proved) from Susanna wife of the said Francis relinquished her right of dower & theirs at the comon law in & to the lands & premises mentioned to be by the said instrument sold & conveyed all which on (illegible) of Richard Kenner was admitt to record and was recorded the eighteenth day of October 1718. This document was transcribed from a copy of the original which is recorded in Westmoreland County Virginia. Recorded October 18, 1718, in Book 6 pages 386-389.
INDENTURE: Indenture of Daniel McCarty to Francis Attwell. This Indenture made the 25th day of March in the year of the Reign of Our Sovereign Lord George the second by the grace of God of Great Britain, France & Ireland, King Defender of the faith for & in the year of our Lord 170- Between Daniel McCarty of the County of Westmoreland Gent: of the one part and Francis Attwell of the said County Planter of the other part, Witnesseth that the said Daniel McCarty for & in consideration of the yearly rent & covenants herein after mentioned and reserved on the part and behalf of the said Francis Attwell to be paid done & performed Hath demised, granted leased and to be farm lett, and by these presents Doth demise, grant, sett & to farm lett unto the said Francis Attwell all that piece or parcel of Land & plantation containing by estimation 100 acres or thereabout (be the same more or less) situated lying & being in Lower Machotick Neck in the Parish of Cople & County aforesaid lately in the Occupation of James Brown, Together with all houses, out houses, edifices, buildings, yards, gardens, orchards, woods, underwoods, trees, ways, waters, watercourses, privileges, commodities, heriditaments and appurtenances whatsoever to the said 100 acres of Land hereby demised unto the said Francis Attwell from the 25th day of December, for and during the natural lives of the said Francis Attwell and Sarah his wife, from thence next ensuing & fully to be complete & ended Yielding and paying therefor & thereout yearly & every year during the lives of the said Francis Attwell and Sarah his wife, unto the said Daniel McCarty, his heirs, Exors. Admins. and Assigns, the Rents or Sum of 630 pounds of Tobacco on the 25th day of December in every year and the said Francis Attwell doth oblige himself to keep in sufficient repair all such improvements as they are, or shall be made on the said plantation at any time during the term of this demise, and likewise that he shall not or any person or persons by him substituted, make any waste or distruction of the timber growing thereon, but only make such use thereof as shall be requisite and necessary for the building and repairing houses, fence, rails and Tobacco Hogsheads for the crops to be made thereon. Provided always that the said yearly rent of 630 pounds of Tabacco shall be behind or unpaid the space of 30 days after the time herein before appointed for the payments thereof or in case the said demised premises building and fencing thereon be not kept in good and sufficient repair or willful waste be committed of the timber on the premises, by the said Francis Attwell or any other person by him substituted so to do, that then in such case, or any of the said cases this present lease and demise to be void and it shall & may be Lawfull to and for the said Daniel McCarty his heirs or assigns to reenter into the hereby demised premises and the same to have again, retain, possess & enjoy as of his proper right and inheritance, and the said Daniel McCarty for himself, his heirs, Exors. & Admins. & Assigns doth covenant promise & agree to & with the said Francis Attwell that he paying the yearly rent & performing the covenants above reserved and contained on his part, shall & lawfully may peaceably & quietly, have, hold, use, occupy, possess and enjoy the hereby demised premises for & during the term of his own & his Wife Natural lives, without the hindrance or interruption of him the said Daniel McCarty, his heirs or assigns or of any person or persons whatsoever claiming under him, them or any or either of them. In Witness whereof the said Parties to these Presents have Interchangeably set their hands and Seals the day and year first above written. Daniel McCarty Seal.
