Probate Litchfield Co Probate 4:442 has his will, dated at Woodbury 4 June 1868 and proved 21 Dec 1870. His wife to have all the furniture and personal property that originally belonged to her, and the income from 20 shares of stock Joel owns in Citizens Bank of Waterbury for the rest of her life. Three thousand dollars to son Marshall to make him equal with his brothers. He set up a trust for his daughter Celia A. Peck to be controlled by his son Henry S. Atwood, and after she dies the property she lives on in Bethlehem to be vested in her children as they reach 21. A trust to be controlled by son in law Elam B. Burton of Woodbury for his children Adelaide and Mary Burton that they are to receive as they turn 21. Rest and residue to be divided in 4 equal parts for sons Henry S., Marshall, Francis A., and Amos B. or their heirs. Sons Henry S. and Francis A. to be executors. The residual legatees divided the estate to their mutual satisfaction on 13 April 1871. (p. 447) Inventory pp 448-52 included $2079 personal, $1216 real estate, 37 notes for about $28,700, plus cash and bank stock almost $5700, for a grand total of $35,648.94. Then on p. 460: The undersigned appointed Distributors of the estate recovered from the Naug. R. R. Co. by the Executors of the estate of Joel Atwood dec'd for damages to his personal property and for the causing his death by Railroad Co's Train of Cars -- whole amount $2347; $93.88 for the waggon divided between the four sons, then half of the remaining by railroad law to the widow, the remaining $1126.56 divided $187.76 each to six legal heirs - Henry S. Atwood, Amos B. Atwood, Marshall Atwood, F. A. Atwood, Mrs. Celia Peck and Adelaide and Mary Burton. The widow named as Mrs. Eliza Atwood. 2 Jan 1872
