Biography

James was born in 1834 in Hythe, Shepway District, Kent England. He was the son of John Ayerst and Anne (?). He passed in 1863.

INQUEST ON A MAN FOUND DROWNED IN THE HUNTER
On Sunday evening last, An inquest was held by the District Coroner, Dr. Knaggs, on a man ascertained to be James Manwaring Eyrest, whose body was discovered floating in the Hunter. The first witness, called was Edmund Bull, who deposed that, on Wednesday evening last, hearing that the deceased was drowned, he immediately proceeded to the spot pointed out in the river where it was said, he had fallen in, and searched for the body, but without finding it. This morning, on hearing it had been discovered, witness went again and found the body lying on its face, and identified it by its features, general appearance, and clothes, as that of James Manwaring Eyrest, his son-in-law. There was no decomposition of the body, or any external marks of violence. Francis Hughes deposed, he was a farmer, living on Dempsey Island; on Sunday, he was coming to Newcastle in a boat, when he heard that the body of deceased was lying near Bullock Island creek, in the Hunter River; after giving information to Mr. Bull, he went to where the body was lying, and after fastening it so that it could not float away, sent word to the police. Peter Byrne deposed, that he was sixteen years of age, and lived with his father on Spit Island; he was employed by the deceased James Manwaring Eyrest, to assist him in loading a boat with hay, battens to bring up the river they loaded the boat, and brought her out into the channel, between Spit Island and the Folly, then they dropped anchor and got into a small dingy to go to the shore for some grub; witness was at the bow, and deceased, was at the stern, engaged in getting a paddle to pull with, when he suddenly fell, and the boat went on its side and filled witness jumped towards the big boat got hold of her and climbed aboard, and, threw a rope to deceased who was in the water; the rope proved too short to reach deceased, who was struggling at the time, and then went down; deceased had told witness before that he could not swim; they were not sky-larking, and deceased's falling was quite accidental; he was a remarkably quiet, sober man,and we had both been at work from early morn.
William Bull, aged twelve years, deposed that he knew the deceased, and the last he saw of him was on Wednesday evening last, about dusk. Peter Byrne and deceased were getting into a small boat from the large one, Byrne got in first; witness turned to go home, and hearing a great splash in the water, looked round, and saw deceassed struggling in the water, and Peter Byrne getting up into the large boat; deceased was then between the shore and the small boat; he was trying to swim, and cried out ' God Almighty, save me for my dear son's sake; deceased sunk, and after rising again, said to witness, 'Willey, I am drowning, go for a boat; he then sunk, and did not rise again; Byrne threw a rope to him, but it was too short; there was no one near to give any assistance; witness then went up and told his father of the accident ; deceased was his brother-in-law.
The jury returned, a verdict of "Accidentally Drowned."
