John Baxter was born around 1843 in Midlothian, Scotland. His parents are David Baxter and Ann. There is some doubt over Ann's surname. John's death certificate as well as well as the death certificate of his father David, states that Ann's maiden name was Jordan. However her own death certificate states that her fathers name was Dunbar.

In 1861, John is said to be 13 years old living with his father and siblings at Crawley Court in Leith, Midlothian.[2]

John Baxter was never married however he did have 2 children with Agnes Sutherland who was his housekeeper.

In 1871, John is said to be 25 and living at No 8 Back of the Vaults, Leith, Midlothian. He is living with his 8month old son Thomas, and his housekeeper, Agnes Sutherland who is also Thomas' mother. The child James O'Neil said to be a Boarder is the son of Agnes Sutherland.[3]
