James Baxter servered in the war of 1812. Rank: Private. Company: commandered by Capt. Joseph Duncan Regiment: Tennessee Infantry Militia, commanded by Col. James Bunch in the Creek war. James Baxter was in the battle of the Horse Shoe. He was honorably discharged at Camp Offsite at Ross Landing Tennessee July 29, 1814 after serving his full six months. He inlisted as a substitute in the place of one Thomas Mantooth on Jan. 10, 1814 for the term of six months.[information from the Pension application records of Rhoda 'Giles' Baxter, widow of James Baxter] Cocke County records show land surveyed for James Baxter as follows: 50 acres on the Caney Fork of Cosby Creek on April 8, 1824, 16 acres on the Caney Fork of Cosby Creek on July 5, 1824, 100 acres on the waters of Cosby Creek on Feb. 27, 1826. James Baxter was the first Baxter to arrive in Cocke County, TN.

Cocke County records show land surveyed for James Baxter as follows: land grant and land transfers transferring land to his children on the Caney Fork of Cosby Creek on April 8, 1824, 16 acres on the Caney Fork of Cosby Creek on July 5, 1824, 100 acres on the waters of Cosby Creek on February 27, 1826.
He fought in the War of 1812. He fought in the Battle of Horseshoe Bend against the Upper Creek Indians or Red Stick, who sided with the British and the Spanish in the war. He fought along side with Bunchs Regt. E Tennessee Militia, Cherokee, Lower Creek, and Choctaw Indians. He fought under Sam Houston, Andrew Jackson and Cherokee leader Junaluska. They won the battle and forced Upper Creeks to sign the Treaty of Fort Jackson. The battle site is now a Military Park called Horseshoe Bend National Military Park in Alexander City, AL
