"Tully, August 13, 1845, at the house of the deceased.....Court receives this testimony. The witness being duly sworn testifies as follows, I am the widow of John Ackles, deceased. Frederick Ackles, Rhoda and John are my children, they are all my children, three of them. I don’t know of John Ackles in his life time, in my presence, denied that Frederick Ackles was his son, because I was so sick that I could not tell. Frederick Ackles is my son born in lawful wedlock. Cross examination. On her cross examination she says. I first became acquainted with the deceased in Fishkill. I can’t tell what year. I came to Fishkill to teach a school & there first became acquainted with John Ackles, had no son when I came there. Can’t tell how long afterwards before I had a son. Can’t tell how long after I was married. Can’t tell if it was a year after I was married before I had a son. I was not married when I first began to teach a school. I taught 2 terms. Can’t tell whether I was married 1st term or 2d term. the fact - of any marriage was known among my acquaintances at the time. I had not ? it was known among his friends. When I was teaching Mother Ackles had a little boy in his petticoats running in & out, but did not attend school already - terms were 7 or 8 months at a time. Married by a minister at the ministers house, living in Fishkill. Can’t remember his name. Frederick Ackles was the son of John Ackles, the deceased has said it himself. I never knew him to deny it. He was born after we were married. I have never said that he was not a son and not our heir. I don’t know that I ever said to Mr. Seely that he was not a son & not an heir. Can’t tell that I ever said so. I never said to Charlotte Ackles that he was not a son or an heir. I don’t know as I ever heard John Ackles say that Frederick was not his son.

Taken and subscribed this 13th day of August 1845, before me.
