Chancery Court Brunswick [county, Virginia] 1783-002
To the worshipful consort of Brunswick County and sitting as chancellor ___ complain ___ sent to your worship your orator JAMES BENTLEY of this county that a certain JAMES SPICER in his lifetime ___ and possess of considerable real ___ state departed this life on or about the 22nd day of July 1767 having first made his last will and testament in the writing and thereby devised to his (written in above this line: son-in-law SAM BENTLEY a suit of clothes and ___) grandson JOHN BENTLEY the sum of 20 pounds in the first place and then ordering that all the residue of his estate to be sold and the money therefore remaining to be equally divided between the said JOHN, SAMUEL BENTLEY and your orator JAMES BENTLEY; having appointed his friend Samuel DAWSON executor of his said will ___ as by the same duly recorded in this county which your orator refers to will fully appear ___ that the said Samuel DAWSON qualified as an executor to the said Spicer and having taken possession of the said Spicer's estate sold the same, the sales of which amounted to near 300 pounds as your orator has heard and verily believes to be true. Your orator therefore since his arrival to his age of 21, hath applied to the said Dawson for his share of the said estate, together with interest upon this time; but so it is that the said Dawson absolutely refuses to pay him, alleging that he is entitled to no interest, that he, the said Dawon, was at considerable trouble and expenses in administering the effects, and therefore is entitled to withhold a considerable sum to indemnify himself which conduct being contrary to equity and good conscious, your orator prays that the said Dawson may upon his corpor _ and __ __ make to all and __ __ __. And more particularly ___ whether the said Spicer was possessed of any state at all? Of what the particular articles? ___ will qualify? What were the amount of the sales? When the money arising from the sale came into the executor' hands? If the executor did not receive it altogether, whether he had not bond for it? James is noted in Onslow NC 1769 and 1770. He cannot be the James in New Hanover 1763 based on the 1767 Spicer will together with his 1783 pleading referring to his age!
