This is the last Will and Testament of me
of Carleton in the County of Lancaster Farmer I give all my household goods and furnishings …. Linen china books and other effects in my dwellinghouse to my dear wife Mary exclusively I give to my daughter Elizabeth Bilsborrow the legacy or sum of two hundred pounds and to my daughter Alice Bilsborrow the like legacy or sum of two hundred pounds And subject to the payment of my debts and funeral and testamentary expenses I give and bequeath all the residue of my personal estate and I devise me real estate (if any) unto my brother Richard Bilsborrow and my brother in law Thomas Atkinson their heirs executors administrators and assigns Upon the trusts following (that is to say) Upon trust to invest the sum of one thousand pounds upon government or real securities in England (with power to vary the same/and pay the income thereof to my said wife during her live And Upon further Trust to invest the residue of my personal estate upon the like securities and to pay and apply the income thereof in and towards the maintenance and education of my daughter Ellen until she shall attain the age of twenty one years and on her attaining that age then to pay and assign the said residue of my personal estate and the securities for the same to my said daughter Ellen absolutely I direct that on the death of my said wife my said trustees shall stand possessed of the said sum of one thousand pounds and the investments and income thereof Interest for and I give the same unto my said daughter Ellen if she shall then be living and if she shall then be dead leaving issue In trust for and equally to be divided amongst her children and the issue of such of these as may have died in her lifetime far stirpies and not far capita And if my said daughter Ellen shall then be dead without leaving issue in Trust for and equally to be divided amongst my other children living at the death of my said wife and the issue of them who may then be dead far stirpies and for free capita I direct my said trustees to sell my real estate (if any) at such time and in such manner as they shall think fit and to give valid discharges to purchases and to hold the purchase moneys and the rents of such real estate until sold upon the same trusts and for the same person or persons as are hereinbefore declared concerning the residue of my personal estate I devise all estates vested in me upon any trust or by way or mortgage unto the said Richard Bilsborrow and Thomas Atkinson and their heirs upon the trusts and subject to the equities affecting he same I appoint my said wife and the said Richard Bilsborrow and Thomas Atkinson Executors of this my Will and I give to them respectively such power of indemnity and reimbursement and of giving receipts as are usual in Wills In Testimony whereof I have hereunto set my hand this twenty sixth day of June one thousand eight hundred and sixty nine-------------------------------------------------------------------------------------------------------------------------

This is a Codicil to the last Will and Testament of my Henry Bilsborrow the Younger of Carleton in the County of Lancaster Farmer and which Will bears date on or about the twenty sixth day of June one thousand eight hundred and sixty nine Whereas I have in and by my said Will directed the trustees thereinnamed to invest the sum of one thousand pounds in a manner therein mentioned and to pay the income thereof to my wife during her life and on the death of my said wife I have directed my said trustees to stand possessed of the said sum of one thousand pounds and the investments thereof In trust for and I have given the same unto my daughter Ellen if she should be then living and if she should then be dead leaving issue In trust for her children and issue and if my said daughter should be then dead without leaving issue In trust for and equally to be divided amongst my other children living at the death of my said wife and the issue of such of them as may be then dead free stirpes and not for capita Now I revoke the bequest of the said sum of one thousand pounds and the investments thereof to my said other children in case my said daughter Ellen shall die in he lifetime of my said wife without leaving lawful issue living at her death and I direct that in case my said daughter Ellen shall die in the lifetime of my said wife without leaving lawful issue living at her decease my said trustees shall stand possessed of the said sum of one thousand pounds and the investments thereof In trust for and I give the same unto my said wife absolutely and for her own use and benefit in all of the respects I confirm my said last Will and Testament and declare this to be a Codicil thereto In Testimony whereof I have hereunto set my hand this eighteenth day of February one thousand eight hundred and seventy

Proved at Lancaster with a Codicil the Twenty third day of August 1871 by the Oaths of Mary Bilsborrow Widow Relict of the deceased and Richard Bilsborrow brother of the deceased two of the Executors named in the Will to whom Administration was granted Power reserved of making the like grant to Thomas Atkinson the other Executor named in the said Will The Testator Henry Bilsborrow the Younger was formerly of Carleton but late of Breck within Poulton le Fylde both in the County of Lancaster Farmer and died on the Twenty sixth day of July 1871 at Breck within Poulton le Fylde aforesaid.
