Death

Daniell Brittin, Senior, of Woodbridge, Middlesex County signed a will dated 5 April 1733; the will was proved 28 April 1733, indicating he died between in the month of April between those two dates.

Last Will and Testament

His Will was dated 5 April 1733 so it is improbable he died before signing one. Per Britton Genealogy by Van Name Oct 1970, page 32 "Daniel (2) left a will dated April 5, 1733, proved April 28, 1733, naming his wife, Elizabeth, children, Daniel, William, Benjamin, Mary, Elizabeth and Deliverance, and several grandchildren. (NJA [New Jersey Archives, First Series] 30:62)"

PLEASE TAKE NOTICE it further states on P32: "A daughter, Mary, was born Feb. 24, 1700 (PW [First Settlers of Piscataway and Woodbridge by O.E. Monette] 253, 264). See Daniel Britton who had a daughter, Sarah, baptized Feb. 5, 1720/1 (WJ [Wilson and Allied Families, by Alfred R. Justice 1949] 108)."

Note: Sarah may have died prior to his writing his will. She is not mentioned elsewhere in the records from what I can ascertain.

The abstract of will the will published by the New Jersey State Archives in 1918 states:[2]

"Daniell Brittin (Britten), Sen`r Date: 05 Apr 1733. Woodbridge, Middlesex Co. will of. Son, Daniell, and his children, Nicholas and Elizabeth Britton. Sons, William and Benjamin, both under age. Daughters, Mary and Elizabeth, at 18 years. Grandson, Daniel, son of John Moores. Daughter, Deliverance, and her children, viz., James, Sarah and Elizabeth Moore. Land in Perth Amboy; lands bought of William Elstone, Moses Rolfe, Peter Codricke, Noah Bishop, John Jaquiss; land joining David Donham, Jun`r. Executors--wife, Elizabeth, John Moores, and son, William Britton. Witnesses--Charles Wright, Benjamin Codington, David Donham, Jun`r. Proved April 28, 1733. Lib. B, p. 400."

Family named in will abstract:

Children

  1. Daniel, father of Nicholas and Elizabeth Britton
  2. William, underage
  3. Benjamin, underage
  4. Mary, "at 18 years"
  5. Elizabeth, "at 18 years"
  6. Deliverance, mother of James, Sarah, and Elizabeth Moore

Grandchildren

  1. Daniel, son of John Moores

The description of the will in the Stillwell Genealogy states:[3]

WILL: Will of Daniel Britton, Sr., of Woodbridge, Middlesex Co., East Jersey, Esquire, written Apr. 5, 1733; proved, at Perth Amboy, Apr 28, 1733 mentioned: "wife Elizabeth, who received half of moveable estate, and negroes Jack and Vashti; son Daniel Britton, Jr. who received lands and buildings in Perth Amboy; son William Britton, who received one-half of his land at Woodbridge, when of age, and negro boy Paris; son Benjamin Britton, who received one-half of his land at Woodbridge and negro boy Oreg; daughter Mary; daughter Elizabeth Britton; daughter Deliverance; Nicholas Britton, son of my son Daniel Britton, Jr.; Elizabeth Britton, daughter of my son Daniel Britton, Jr.; Daniel Moore, James Moore, Sarah Moore and Elizabeth Moore, children of my daughter Deliverance and her husband John Moore. Executors: wife Elizabeth, John Moore, and son William Britton," " Stillwell Genealogy," p. 129 (BRI HIS 009)[citation needed]

This description varies slightly from the abstract. The original will is on microfilm at New Jersey State Archives if a researcher wants to verify this information.

Slaves

Slaves named in the will are:[4]

Burial

He is buried in Presbyterian Churchyard, Woodbridge, Middlesex, New Jersey.[5] The FIndagrave memorial has a photo of his badly damaged (but partially readable) gravestone. The memorial contains these two statements (sources not indicated):

"Capt. Daniel Britton, a prominent man in the township in his day, died in 1733, and his children lie asleep around him."
"August 15, 1708, he and his wife [Elizabeth] joined the Presbyterian Church in Woodbridge; March 13, 1716 he and Samuel Dennes, Jr, were appointed on the committee to build a jail and courthouse; the following year he was made town treasurer."

Daughter Deliverance was said to be a wife of John Moore or Moores, and John Moore was an executor of Daniel Britton's will.

Currently, Deliverance is married to a James Moore, who was named in the will of his father James. James the father had no son John, so it seems she and the kids need to be disconnected from Moores-288 and a new profile for John Moores needs to be created.

Who is he though? He's not the John Moores who died in 1745 or 1774 (children don't match).

from Sally Shreeve:

I believe the Elizabeth Murney shown as Daniel's wife is Elizabeth Powell. Her second husband was John Murray according to Stillwell Gen. Vol. 4 p. 129. I think someone mixed the two names. The two Elizabeth's both show the same month and year death date. Sally Shreeve

Brittain-42 and Britton-766 appear to represent the same person because: It appears that despite source information in the text block referring to the surname Britton, Brittain-42 was created using a LNAB not used during Daniel's lifetime as evidenced by his headstone. Now both profiles mistakenly appear in the tree as brothers.
