Private Thomas Brown served for Tennessee in the War of 1812

Thomas Brown was born on June 28, 1773, in Fincastle, Virginia. Thomas Brown was a native of Virginia and a pioneer settler of Jackson County, Tennessee.[1]

He married Nancy Litton in Botetourt County, Virginia (date of marriage bond, 5 November 1795).[2] They had seven children during their marriage.

At the age of 42 years he enlisted in Captain Mathew Cowan's Company of the 3rd Regiment (Roulston's), West Tennessee Militia, Infantry as a Private. This Regiment was present for the Battle of New Orleans and had casualties.[3]

Thomas served in the rank of Private in the West Tennessee Militia during the War of 1812.

The 1850 and 1860 census finds him with Elizabeth Brown, about 10 years his junior.[5][6] Elizabeth Brown is named his widow in court records following his death.[7]

He passed away October 1, 1862 in Jackson, Tennessee at 89 years of age. Thomas was laid to rest in Brown Cemetery, Flynns Lick, Jackson County, Tennessee.[8]

No information on the parents, siblings, birthdates, or birth places of either Thomas or Nancy has been determined as of the date of this writing. The first documented evidence uncovered is the filing of their marriage bonds at the Fincastle Courthouse, Botetourt County, Virginia.[7]

  • He married Nancy Jane Litton (b 1755), daughter of John Richard Litton and Sarah Ann Wilcoxen, on 5 or 6 Nov 1795 in Tinkers Creek, Botetourt, VA. They moved to Jackson Co. [TN] to a large farm near Gainesboro, where Nancy died about 1807.[7]
Additional information posted by Larry Brown about Thomas: Documented evidence of Thomas and Nancy is the filing of their marriage bonds at the Fincastle Courthouse, Botetourt County, VA on 11/5/1795, both signed with an "X". Nancy Litton & Thomas Brown 11/6/1795 b- John Dollard. Nancy gives own consent 12/4/1795 John Dollard who test. Age of bride as over 21. There is strong evidence that Nancy’s home was in the Tinker Creek Area of Botetourt County. There is the possibility that Thomas came from the Beaver Dame Creek Area of adjoining Bedford County VA. The couple migrated to Jackson County after the birth of Dudley in December 1799, but before the birth of Henderson in May 1802. Their land was along the Dry Fork of Flynn’s Creek. How Thomas acquired this land is unknown but Caroline DeBiase did find a Thomas Brown was granted Army Lands from the Virginia Military District in 1801, (page 11). Since Thomas would have been too young to have served in the Revolutionary War, any grant originating from service in the Continental Army would have been passed to him from his father, or uncle, etc.Thomas did serve in the war of 1812, but by that time he was well established in Jackson County.Thomas Brown’s farm was 8 miles from Gainesboro, TN, west on Highway 53 to Fork of Creek School House, then left and up Dry Fork of Flynn’s Creek 14 miles.In 1936 Sid Ragland occupied this farm (Tennessee land archives, 5/5/1801)[7][9]

It seems that Thomas had nine (10?) children - all but one or two by Nancy: "Nancy died sometime after the birth of Mercilla in Sept. 1810. The 1820 census gives no evidence of her being a part of the household. Thomas died after 1860. His estate settlement is recorded in Minute Book D-Chancery Court-August Term 1867. The context of the report states that the matter had originally come before the court in August, 1866."[7] The Court record (above) is dated 6 November 1865.[10]

Location Notes

The Fincastle Courthouse mentioned in the biography is in the town of Fincastle (not Fincastle County), which is the county seat of Botetourt County.
Tennessee "was admitted to the union on June 1, 1796 as the 16th state. What is now Tennessee was initially part of North Carolina, and later part of the Southwest Territory."[24] Tennessee seceded from the union on 8 June 1861 and was not readmitted until 24 July 1866.[25]

I am curious if anyone has the full 22 pages of the court case listed under sources. Does the court case mention any of the names of Thomas BROWN's deceased children?

Larry Brown's online tree, entry for Thomas, has information from the court case & information about the relationship of those named with Thomas.
