Biography

1776 Project
Peter Bundy served with Massachusetts during the American Revolution.

Peter was born in 1754 to Peter Bundy and Priscilla Prentice[1]. Following his marriage to Bathsheba Avery, he relocated to New York, taking up residence in Otsego County[2][3]. He passed away in 1822[4].

Be it remembered, That at a Surrogate Court, held for the county of Otsego, at the Surrogate Office in the Village of Cooperstown on the 20th day of June in the year of our Lord one thousand eight hundred and thirty-two,

Present, Elisha Foote Surrogate. In the Matter of the Real Estate of Peter Bundy Deceased.

Comes Stephen A. Bundy & Gilbert S. Bundy Devisees of Bursheba Bundy deceased who was Deviser of said Peter Bundy late of the said county of Otsego, deceased, and informed the said Court that a notice had been given pursuant to the Statute in such case made and provided, of their intention of proving the Last Will and Testament of the said Peter Bundy deceased; and the said Stephen A. Bundy & Gilbert S. Bundy brought into this Court a notice of their intention to prove the said Will, signed by the said Stephen A. Bundy and Gilbert S. Bundy with the affidavit of Daniel Knap Junior proving the due service of said Notice upon all the Heirs and Devisees of the said Peter Bundy deceased, which fact appears by the affidavits of the said Daniel Knap Junior and Stephen A. Bundy which said Notice and affidavits are as follows, to wit: To Levi Bundy Ephraim Bundy James Bundy Peter Bundy David S. Bundy Wheeler French and Eunice French his wife Elisha Shephard & Rebekah Shephard his wife Daniel Shephard & Julia Shephard his wife Sally Bundy & Marilla Bundy heirs of Peter Bundy deceased late of the Town of Otego of the County of Otsego, State of New York and all others whom this notice may concern. You and each of you are hereby required to take notice that we shall apply to Elisha Foote Esquire Surrogate of the County of Otsego, at his office in the Town of Otsego, in the County of Otsego, on Wednesday the twentieth day of June next at eight o'clock in the forenoon of that day to have the last Will & Testament of the said Peter Bundy deceased proved & recorded pursuant to the Statute in such case made & provided.

Dated Otego May 28th 1832 Stephen A. Bundy Gilbert S. Bundy Devisers of Berrsheba Bundy deceased who was Deviser of said Peter Bundy deceased

State of New York Otsego County Daniel Knapp Junior of the Town of Otego, in the County of Otsego, being duly sworn deposes & says that he this deponent did serve personally on the twenty eighth day of May last true copies of the above notice on the above named Wheeler French and Eunice French his wife & Daniel Shephard and Julia Shephard his wife by delivering the same to the said Wheeler French & Daniel Shephard respectively and did serve personally on the twenty ninth day of May last true copies of the above notice on the above named Ephraim Bundy David S. Bundy Moses Bundy by delivering the same to them respectively and on the above named Elisha Shephard & Rebekah Shephard his wife by delivering the same to said Elisha Shephard and did serve personally on the thirtieth day of May last true copies of the above notice on the above named James Bundy & Peter Bundy by delivering the same to them respectively and did serve personally on the thirty first day of May last true copies of the above notice on the above named Levi Bundy Sally Bundy & Marilla Bundy by delivering the same to them respectively and this deponent further says that he is personally acquainted with the said several persons above named & that they all and every one of them to reside in the County of Otsego & State of New York and further this deponent says not

Stephen A. Bundy being duly sworn, deposeth and saith That he is the Deviser of Bursheba Bundy deceased who was a deviser named in the Last Will and Testament of Peter Bundy deceased, and also signed the annexed Notice, and that there are no Heirs or Devisees of the said Peter Bundy interested in his real or personal Estate, besides those named in the above affidavit and further saith not. ,

Whereas the said Court, being satisfied with the Proof made in the premises, that due notice has been given according to Law, of the intention to have the said Will of the said Deceased proved, according to the Statute in such case made and provided: It was therefore Ordered, on reading and filing the above affidavits, by the said Court, That Stephen A. Bundy & Gilbert S. Bundy have leave to proceed to prove the said Will of the said Deceased, and thereupon the said Will being produced and shown to the said Court:

Be it remembered, That on this twentieth day of June in the year one thousand eight hundred and thirty two before me, Elisha Foote Surrogate of the county of Otsego, personally appeared Daniel Knapp Junior who being by the said Surrogate, duly sworn and examined, doth depose and say, That this Deponent was well acquainted with Peter Bundy deceased; that he was present as a witness, and did see the said Peter Bundy deceased, subscribe at the end thereof, the Instrument now produced and shown to this Deponent, purporting to be the Last Will and Testament of the said Peter Bundy deceased, bearing date the ninth day of January in the year one thousand eight hundred and twenty two That such subscription was made by the said testator in the presence of this Deponent; That the said Testator at the same time, declared the Instrument so subscribed by him to be his Last Will and Testament: Whereupon, this Deponent signed his name at the end thereof, at the request of the said testator and that the said testator at the time of executing and publishing the said Last Will and Testament, was of full age, of sound mind and memory, and not under any restraint.

And thereupon, it appearing to the said Court, That the said Will of the said Deceased, was duly executed according to Law, and that the said Testator who executed the same, was, at the time of making such execution, of sound mind and memory, of full age, and not under any restraint. It is therefore Ordered by the said Court, on due deliberation, that the said Will, together with the proof thereof, be recorded; which said proof is herein before recorded and contained, and the said Will, so ordered to be recorded, is as follows, to wit:

The last Will & Testament of Peter Bundy

I Peter Bundy of the Town of Otego in the County of Otsego, and State of New York considering the uncertainty of this mortal life and being of sound mind & memory do make and publish this my last Will & Testament in manner & form following. That is to say First-It is my desire that my funeral expenses and debts shall be paid & discharged as soon after my decease as conveniently may be.

I give and devise unto my beloved wife Bursheba Bundy her heirs and assigns forever All that certain lot price or parcel of land situate and lying in the said Town of Otego, in the County of Otsego being known & distinguished by Lot number one hundred & fifty-five in a map & division of the Tract of land granted to Hugh Wallace & others containing by estimation three hundred & seventy-four acres and being the farm on which I now reside To have & to hold the same unto the said Bersheba Bundy her heirs & assigns forever after paying & discharging my funeral expencis and debts out of my personal property.

I give and bequeath unto my said wife Berrsheba Bundy one-third part of all my personal estate property and effects to be delivered to her as soon as conveniently may be.

I give and bequeath the remaining two thirds of my personal estate property and effects unto my children Levi Bundy Ephraim Bundy James Bundy Peter Bundy Junior David S. Bundy Moses Bundy Stephen A. Bundy Gilbert S. Bundy Eunice French Rebekah Shephard Sally Bundy Julia Bundy and Marilla Bundy to be equally divided between them share & share alike. If any of my said children shall die before division of my personal estate & property then I order and direct that the share or part which is intended for such as shall die shall be paid and delivered to the heirs of those who shall so die.

Lastly. I do hereby nominate constitute & appoint the said Levi Bundy & David S. Bundy Executors of this my last Will & Testament hereby revoking and annulling all former Wills by me at any time made.

In witness whereof I have hereunto set my hand & seal the ninth day of January in the year of our Lord one thousand eight hundred and twenty-two.

I Elisha Foote, Surrogate of said County do hereby certify that in pursuance of Chapter 6th Title 1st Article 1st Part 2- of the Revised Statutes of the State of New York upon proofs & examinations taken in the County aforesaid, on the twentieth day of June 1832 by the oaths of Amos Douglass Daniel Lawrence & Daniel Knap Junior the subscribing witnesses to the foregoing Will_ That the foregoing Will was duly executed_ That the Testator at the time of executing the same was in all respects competent to devise real estate and not under any restraint. And I the said Surrogate do further [] that the said Will is recorded in my Office in the Book [] kept by me for recording Wills Testaments & Codicils proved before me & the proofs thereof in pages 665-670.

In witness whereof I the Surrogate L.S. aforesaid have hereunto affixed my official Seal this 3rd day of July 1832.
