- Will of Samuel Burks, 6 Oct 1755, St. Anne's Parish, Albemarle Co., Virgina. Will probated 12 Feb 1756.[1]
- I, Samuel Burks, of Saint Annes Parish, county of Albemarle, being of sound mind and memory do make and declare this to be my last will and testament. I give my son, John Peartree Burks, negro boy named Prince. To my daughter, Mary Smith, 1 negro named Lyddia. To my beloved wife, Mary Burks, durning her natural life, the use of the following slaves now belonging to me, Toby, Frank, Nan, Phillis, Tom, Simon, Flora, Bejo, Jammy, Will and Lucy as well as the use of all my houses and lands, the use of all my personal estate not already disposed of. Also to wife Mary, 200 acre tract on Cunningham Creek. After my wife's decrease the tract of land whereon I now live containing 600 acres is to be sold and money given as follows: to my daughter Elizabeth Cabell, one shilling sterling money, my son, Samuel Burks, one shilling sterling money, my son Richard Burks, one shilling sterling money; residue of said money to be equally divided between son John Peartree, Charles, daughter Mary Smith and grandson Samuel Burks, son of my son Samuel or representatives.
- Lastly, I do appoint my said wife Mary Burks and my friend John Smith, Jr., Executors of this my last will and testament. In witness Whereof I have hereunto set my hand and seal this 6th day of October in the year of Our Lord 1755. The will was witnessed by Samuel Hopkins, Jos. Thompson and William Moore.

Burks-304 and Burks-27 appear to represent the same person because: I think these should be merged. it's possible the family had two John Peartree Burks & the one b 1710 died before the one b 1720, but no evidence of such a situation is given on the profiles ... probably better to work with just one combined profile for John Peartree Burks. Please merge (or post evidence of a "died young" 1st son). Thanks!
