Biography

Walter was born about 1768.

Walter married Mary Lively in 1787. Walter was under 21 and needed consent from his father John Burris. Mary died sometime between 1810 and 1819.

Walter remarried to Lucy Shekell on 1 April 1819. Lucy's father Cephas Shekell gave bond.

Walter passed away in early 1836 in Albemarle County, Virginia. He was NOT the Walter Burris that died three years later in Missouri.

The only thing that needs to be changed is instead of his death info being late 1839 Missouri it needs to be early 1836 Albemarle County, Virginia. This Walter was married to (1) Mary Lively in 1787 and (2) Lucy Shekell or Shikell in 1819. If you go to the 1820 Census (VA, Albemarle) you will find Walter Burrus next to Lucy's father Cephas Shickell. The Virginia Walter Burrus wrote his will in April 1836 and there is a probate file in the courthouse. He left his estate to his children by his second wife who were still young. This is actually NOT uncommon and the older children were not "disowned" as people would assume. In those days it was not uncommon to leave your estate to those children that NEEDED to benefit but not to those children who were married and had their own families. So in this case the will does not mention any of his children by Mary Lively. It's not out of spite I'm sure. Now as far as who the children were specifically people will just have to make a circumstantial list based on marriage dates and proximity. Here is MY list of Walter's children by Mary Lively. Some birth years are ESTIMATES based on marriage date which works *most* of the time in sorting children. Please do your own research but I think this list is *mostly* accurate.

1. Walter Burrus Jr, The 1815 tax roll lists a second male over 16 years (1814 just had one male, Walter) indicating a male became 16 years old in 1815. [Added to this family because of same name and residence in 1824 in Hart county, Kentucky. Other family members were in Hart county at the same time]

2. Mary Jane "Polly" Burrus was born about 1788 in Albemarle county, Virginia. She married David Durham on 19 March 1817 in Albemarle county, Virginia. Mary died after 1870 probably in Albemarle county, Virginia.

3. Mourning Burrus was born 10 Jan 1789 in Albemarle county, Virginia. She married John Durham on 28 Jan 1811 in Albemarle county, Virginia. They moved to Hart county, Kentucky by 1820.

4. Agnes Ann R. Burrus was born about 1790 in Albemarle county, Virginia. She married Thomas M Gillock on 29 Sep 1808 in Albemarle county, Virginia. They moved to Martin county, Indiana.

5. Nancy Burrus was born about 1790 in Albemarle county, Virginia. She married Robert Gillock on 2 June 1806 in Albemarle county, Virginia. They lived in Barren county, Kentucky; Sangamon county, Illinois; and Lawrence county, Missouri. Nancy died after 1870 probably in Missouri.

6. Matilda Lewis Burrus was born about 1803 in Albemarle county, Virginia. She married William Knight on 23 Dec 1819 in Albemarle co., Virginia They moved to Kentucky by 1827 and to Hart county, Kentucky by 1830. Matilda died after 1880 probably in Hart county, Kentucky.

7. Amanda Burrus was born 1801 to 1804 in Albemarle county, Virginia. She married Robert Burgess on 24 May 1828 in Albemarle county, Virginia.

8. Eliza Burrus was born about 1807 [estimated] in Albemarle county, Virginia. She married Edmund T Lacey on 26 May 1828 in Albemarle county, Virginia.

Walter gave bond for many of these marriages but one or more may actually be children of Walter's brothers.

The Walter Burruss who died in Missouri is from South Carolina and was Loyalist Militia roll, Ninety-Six District. The regiment was raised from Laurens county.

If you need more information to show that there are two Walter Burruss just let me know.

Which Walter Burris married Mary Lively? One of them must be shown with the wrong wife and family. And are their children mixed up too?

No, people have conflated two different Walters...........

There were TWO men about the same age named Walter Burris / Burrus living at the same time but in completely different areas with completely different families and both are fully documented as such.

One Walter Burrus lived his entire life in Albemarle County, Virginia and died there in early 1836. He was married to Mary Lively and Lucy Shekell.

The other Walter Burris started out with his father in Laurens County, South in the 1760s; moved to Clark County, Kentucky 1795/96; and then moved to Missouri about 1809 with his brother David Burris. This Walter died in late 1836 in Jackson County, Missouri. He married to a still unknown woman in the 1780s in Laurens and then remarried to Lydia Barnes on 28 May 1807 in Clark County, Kentucky.

Somehow people have conflated these two different men into one person and since then every Ancestry tree has repeated the same bogus info. Decades ago everyone just ASSUMED the Walter seen in Boonville, MO in 1811 was the same Walter seen in Albemarle County, VA in 1805 and never did any further research. The most basic genealogical research proves they are not the same person. Both men continue to be documented as separate people going forward and backwards in the local records. I have these extensive records in my Ancestry profile for BOTH and the records appears in the hints at Ancestry.

I would also like to take this opportunity to talk about the parents of Martha Cottrell. I see that “trees” have Richard Cottrell and Judith Smith as parents of Martha Cottrell who married Benjamin Lively. First questions I have, does anyone have a married marriage record? I know that that Benjamin Lively and Martha named their first child Cottrell which is probably name after her surname name. In Richard Cottrell “will” he listed the following daughters – Ann Lancaster, Martha Cottrell, Mary Ann dec (some of her Children listed) and Judith Smith Nicholas or Nicholson. If you notice all but one daughter is listed by her married name but Martha. She is listed as Martha Cottrell which would mean she was not married as of the “will”. We do know that Benjamin and Martha first child Cottrell was born 1763 and their last child Mark born 1782. Which means if she was indeed the daughter of Richard Cottrell would she do listed as Martha Lively? I have also notice trees are sourcing family books like “Cottrell Ancestry” by T C Cottrell. On pg 27 the books states, “Martha may also have married Benjamin Livley” Which tells me the author does not have proof that the Martha Cottrell daughter of Richard Cottrell is the same Martha Cottrell that married Benjamin Lively. More research needs to be done.

Thank you for posting this. So many Ancestry trees still conflate the VA Walter Burrus with the and the SC-KY-MO Walter Burris. There were living at the same time but in completely different areas with completely different families. Both are NOW (since new research in 2015) fully documented as such.

I've contacted a minimum of 500 people on Ancestry from both Walters and explained how two different Walters have been conflated into one person and gave them links to my research on my Rootsweb page. I think only a few people fixed their trees as a result. Very frustrating.

I hope other people take the time to contact anyone with the old info and explain it succinctly. Maybe when people get contacted by more than one person they will actually try to fix their trees. Unfortunately it seems most people on Ancestry care more about adding ancestors than actually verifying ancestors. In my independent research on all my lines I have to review other people's trees to see if someone found a relevant record aside from "hints" and it's shocking how many trees just have nonsense, illogical and outright fictional info.

This Walter Burrus died April or earliest May 1836 in Albemarle county, Virginia. He had a will where he left his estate to the daughters of his second wife Lucy Shekels. The Missouri Walter Burris is an entirely different person that keeps getting conflated with the Virginia Walter Burris.
