Case brought in County Court following the death of Robert Hope

  • Jun 1861, John's mother Ann brought a case against Robert Pemberton, the treasurer of the Philanthropic Burial Society for the recovery of an underpayment on a burial policy following the death of her nephew Robert Hope on 16 Mar 1861.[6]
The society had made a payment on the basis that Robert was a halfpenny member rather than as a penny member which was what Ann believed him to be. The confusion had arisen because Ann had been paying two subscriptions for people name Robert one being for her nephew and the other being for her son Robert Grogan.
The judge examined the register cards and found that on the card of the penny member, claimed by the Society to be the card for Ann’s son, there were entries under the various names of Robert Grogan; Robert Gross; Robert Carr and Robert Carr Hope.
The judge ruled that the confusion had arisen amongst the officers of the Philanthropic Burial Society and made an order for them to pay the amount claimed by Ann.
During the case, John, along with his brother Edward, gave evidence with both being recorded under the last name of Hope. There was no report of his brother Robert giving evidence.
