Biography

CREED CHILDERS 1763 will of his father gave him, "The home tract" - 396 acres known as Short's Survey abd 533 acres promised to his father from Stephen Hughes.


DEED

Albemarle Co, Virginia Whereas 12 June 1762 as recorded in the General Court of this Colony for 533 acres, did bind himself in the sum of $1,000, payable to Abraham Childres, to sell the 533 acres on both sides of Moore's Creek and whereon the said Stephen Hughes lived on and agreed to make a good deed to Abraham Childres. Whereas by his last will, proved in the county of Albemarle did devise the said 533 acres to his son Creed Childres

Albemarle Co, Virginia 08 Mar 1765 - Stephen Hughes and Sarah his wife of Albemarle of the one part to Creed Childres of the same Co. Whereas said Stephen Hughes being seized of land in Albemarle purchased by Hughes of Richard Randolph and Anne his wife, 12 June 1762 as recorded in the General Court of this Colony for 533 acres, did bind himself in the sum of $1,000, payable to Abraham Childres, to sell the 533 acres on both sides of Moore's Creek and whereon the land the said Stephen Hughes lived on and agreed to make a good deed to Abraham Childres. Whereas by his last will, proved in the county of Albemarle did devise the said 533 acres to his son Creed Childres - now this day do deed the said tract unto Creed Childres. signed: Stephen Hughes, Sarah Hughes (who released her right of dower) wit: J. (NOTE: the following 400 acres, by re-survey, is the 396 acres, the home tract left Creed by his father, Abraham)

15 Jan 1767 - Creed Childress to John Ware, both of Albemarle Co - for 150 pounds - sold to John Ware - 400 acres of land beginning at an oak by the River on the west side of a run at William Cannon's corner, running thence on William Cannons line up the Run according to its meanders South West to a tree on new lines north West to an oak these South West down the Run to a tree, southwest to a oak by the river and up the river to the first station. PLEASE NOTE: The Abraham Childers who witnessed this was literate, so he was NOT Abraham Childers, brother to Creed, for we have his bold and clear signature from Cumberland Co.

WHILE I have found no grantor deed from Creed Childers, it appears that Nicholas Lewis has acquired by October 1765 the 533 acres of land that Stephen Hughes sold to Abraham, then to his son Creed Childres in March of 1765.

A guess for this "missing deed" might be that Creed was under 21 and sold it without a guardian and maybe it was awaiting his being of age. I know under Virginia colonial law a minor could sell land but that was very rare indeed and easily challenged in General Court. The details of the land transfer is but a guess on my part.

Oct 1765 - Thomas Walker of Albemarle Co., Trustee for conveying the Town Lotts of Charlottesville - several of these lotts are on both sides of Moores creek adj the land of Nicholas Lewis being Childers' other lands of the said county.

11 Oct 1765 - Nicholas Lewis of Albemarle, Fredericksburg Parish to John Moore of same - 5sh sold to John Moore - 2 tracts of land - 27 acres on the upper ends adj the land he purchased of Childres on the N side of the main road and 6 more acres on the south side of Moores Creek purchased of Solomon Nelson and Edward Carter, the land adj to where his and the said old line of Childres crosses the creek. Recorded: Oct Ct 1765

Abram Childers & ..... Baptized 1763, a Son named Creed born about 17 years agoe. p. 64. Dec: 23 1763—Capt: Childers fun: Sermon in Albemarle, on Ecc: 12.7.—p. 36. Dec. 23 1763—Capt. Childers fun: Albemarle, p. 124.


Father of Meredith and Patrick Childress (who married Goen / Going sisters) was likely a son of Abraham Childress and Woman Unknown (Creed) born between the death of his first wife in 1741 and marriage to his third wife Lucy Thomas aft 1754 i.e. Creed Childress born ca 1746 baptised 1763 Goochland VA, is mentioned in Abraham's 1763 Will. He may have died during the Revolutionary War, the last record found for him so far was on a muster roll of 1779.

1767 Jan 15 recorded 1768 May 13 VA Albemarle: Creed Childers sold to John Ware 400 ac by the [James] River on the west side of a run and William Cannon's land, for which he rec'd £150, wit W. Henry, James Holton, Daniel and Thomas Tilman, Charles Curd, Edmond Winston, Abraham Childers [IV], George Seaton, Philip Henson and John Meldon.

Douglas left Goochland Co., in 1777 (after a fight with the vestry of the Parish of St. James Northern) and moved to Louisa County, thus the records after 1777 are, for the most part, for folks in Louisa.
