Judith (Collier) Hicks was a Virginia colonist.
Judith Collier, daughter of Isaac Collier[2] and Ann (Vines) Collier, married in Brunswick County, Virginia.[3] She is named in the will of James Hicks as "beloved wife Judith Hicks" (will proved 1793 in Brunswick County).[4]
Children named in James Hicks' will, dated 20 March 1789 and proved in Brunswick County Court on 23 December 1793:[5]

This "last Will and Testament of James Hicks Senr. decd. was proved according to law by oaths of the witnesses thereto and ordered to be recorded, and on the motion of Charles and John Hicks two of the exors therein named who made oath thereto and together with Vines Hicks, Robert Watson, and Robert Hardaway their securities entered into and acknowledged a bond in the penalty of four thousand pounds with condition as the law directs Certificate is granted them for obtaining a probate thereof in due form liberty being reserved for the other executor to join in the said probate when he thinks proper." ~ Will Book 5, page 518, Brunswick County, Virginia[7]

Regarding relationships:

She was the sister of Elizabeth (Collier) Smith.
  • Isaac Collier's 1771 will (see his profile) names daughters Judith Hicks and Elizabeth Smith. Hicks researchers are divided as to Judith's father-in-law (Robert or George).
Judith married James Hicks, the son of <s>Robert Hicks, about 1754 in Brunswick County, Colony of Virginia.[citation needed] Research indicates she married James, son of George, but citation for date of marriage still needed.

Judith Collier m. James Hicks, of Brunswick Co., Va., and had two daughters and five sons, four of whom were officers in the Continental Army, and two of whom were captured by the British at the battle of Brier Creek, Ga. Probably lived at Hicksford, in that part of the county subsequently set aside as Greensville Co. Issue : — 52, Capt. Charles Hicks, revolutionary patriot. 53, Isaac, 54, George, d. in Georgia. 55, John, d. near Bruce's Church, Brunswick Co. 56, James, d. near Jericho, Brunswick Co. 57, Vines, moved to Tennessee. 58, Sarah, b. 1762, m. Robert Hardaway. 59, Ann Vines, b. 1766, m. Dr. William G. Walker.

Robert Hardaway, who was one of those securing the bond for her husband's estate, was the husband of daughter Salley Hardaway that James named in his will,[8] but their marriage record was not found in the "Brunswick Marriages" reference.[1] The FamilySearch Virginia Marriages database shows their marriage as 1 November 1783.[9] The Sarah Hardiway found in Brunswick County's 1810 census is probably her (see [[Hicks-11237|her profile).[10]
Nancy Hicks married "Dr. Wm. G Walker".[11]
If the Myhill Collier who witnessed her husband's 1789 will is her brother, that shows he was living in 1789 (his profile has that he died "after 1776"). Isaac Collier's will names both son Myhill and daughter Judith Hicks (will dated 8 July 1771 and proved in Brunswick County).[2]

Discrepancies: A variety of dates and birth/death locations have been given for her:

IV; 80, indicating the source is her father's will, not a record of their marriage.

Husband James Hicks

This profile represents Judith, daughter of Isaac Collier. Her niece, Judith Collier (daughter of her brother Charles), married a different James Hicks (son of James - apparently this Judith's husband).
The marriage date listed for Judith, daughter of Isaac, in Marriage Records of Brunswick County, Virginia, 1730-1852 - 8 July 1771 - matches the date her father wrote his will, naming her Judith Hicks, and the entry in the reference includes "(W.B.IV; 80)". The entry also does not include the given name of her Hicks husband, supporting that 1771 was not actually their marriage date.[1]
A record of a Judith Collier marrying a James Hicks in 1754 is needed. That date appears to be based on the entry for "Hicks" in a book documenting Virginia's Sons of the Revolution.[13] In that pedigree, it shows the soldier, Isaac Hicks, to have been born in 1755 to James and Judith (and shows James's father as Robert who died 1739). The "Hicks" information is followed by a note that "This descendant of the Hicks family is based on records of wills and deeds in Brunswick County, Virginia." However, it appears that the son James named in Robert's 1739 will was married to first Martha (who is named in a 1744 Brunswick County land record) and then Fathy (who is named in his 1760/61 will)[14] and is a different James than the one who married Judith and left a will (naming her) dated 1789/proved 1793.

Judith Collier-6331 was born in 1732 to Isaac Collier and Ann Collier. She passed away in 1798. She is listed as a devisee in her father's, Isaac Collier's, will.[15]

Research Notes

This Judith (Collier) Hicks-6331 is the older cousin of Judith (Collier) Hicks-4008 who was born in 1766. The son of this Judith and her husband James, James Hicks, Jr., married his cousin, Judith Collier the younger, in Brunswick County, VA in 1787. According to the marriage record dated 26 November 1787, the bride of James Hicks, Jr. is Judith Collier, daughter of Charles Collier. [16] Her mother is Susanna Smith (Charles Collier and Susanna Smith were married in Sussex Co., VA January 27, 1759).4 Charles Collier was the son of Isaac Collier and Ann Vines (see the Will of Isaac Collier on page 8).

    • Charles, John, and Isaac, being named Executors, would have been 21 or older, so born 1768 or earlier. usually... see circumstances when under 21 executors are named in "Bob's Genealogy Filing Cabinet" article Legal Age (by Robert W. Baird).
    • His daughter Salley was married, so she would probably have been born within 5 years of 1768.
    • Bequests to Charles and James included "land joining the land whereon he now lives" (Charles) and "the plantation whereon he now lives" (James). He left "the plantation whereon I now live" and other lands to his son Vines. I believe that in colonial Virginia, you had to be 21 to own land.
    • It is unclear by the bequests made to Nancy whether she was of age or not (e.g., no provision for her care or mention of a dowry).

Collier-6331 and Collier-419 appear to represent the same person because: These profiles represent the same person. I removed incorrectly attached husband and son who belong to her niece of the same age.
Removed James Hicks b. 1750 because this is her son, not her husband. Removed Isaac Hicks b. 1809, because this is her niece, Judith (Collier) Hicks' son, not her son.

See "Virginia Marriages, 1785-1940", database, Brunswick County. FamilySearch ([https://www.familysearch.org/ark:/61903/3:1:3QSQ-G9XF-2SXS?i=21 image, page 22 of 572), accessed 15 Dec 2020, lists Colliers for an Edmund Collier married a Judith Hicks in 1799.

edit/update - this Edmund's wife Judith is not James's widow... this list says Judith Hicks "daughter of John", so even if the widow Hicks, not this Judith. Also, I might have mistyped the date before (can't check JSTOR, I'm over my limit). Other sources have 6 Jan. 1796 (the Google Book just cited, for example).

found a more likely "post-1799" for her... 1810 census of Meherrin Parish/District of Brunswick County has a Judith Hicks adjacent to Hardiways.

In her household: 1 male 10-15, 1 male 45+ and one female 45+ (see http://www.usgwarchives.net/va/brunswick/census/1810/meherrin/0750.gif for the image & http://www.usgwarchives.net/va/brunswick/census/1810/index/imgindx-meherrin.txt for the index)

The profile for the husband of the "other" Judith Hicks (her niece Judith who married a Hicks) shows him as living in 1817, in Craven, South Carolina, and her death as after his.

Hi Jeff! Could you add some date guesses for this family? I just set her in an unmerged match with Collier-3226, but that family has issues... if it were just one date, maybe a century typo, but Judith is b/d 1733-1830 & is married to John Hicks b 1636 with son born 1658.

If you could give a decade (or even a century) for this Judith Collier m James Hicks, that would help.
