info: [1964] NZLR 241, 247: later appealed [1965] NZLR 191. - Smith v. Auckland Hospital Board - Smith was about to have an operation to clear some kind of plaque out of his arteries. The doctors knew that there was a risk that the plaque would dislodge and somehow travel to another part of the body cutting off the blood supply. That is what happened, this plaque lodged in his leg and caused gangrene and then his leg had to be amputated. The doctors were held liable because Mr Smith had asked pointed questions like are there any risks and the doctors just told him not to worry.
