Biography

Hannah, daughter of Joseph & Elizabeth, was born on 16 May 1795 and baptised in Essex, England.[1]

I ***Hannah Cross*** of Colchester in the County of Essex Spinster do make my last will and Testament in manner following that is to say I appoint my nephew, ***Joseph John Cross*** of the High Street in Colchester Upholsterer Executor and my niece ***Eliza Ann Barritt*** Executrix thereof and I give to each of them if they prove my Will the sum of Nineteen pounds nineteen shillings. I bequeath to my said niece ***Eliza Ann Barritt*** all my household goods and furniture plate linen wearing apparel books glass and china (except such household goods furniture and effects in my house at Walton within the Soken as may belong to me at my decease) for her absolute benefit I bequeath to my said niece ***Eliza Ann Barritt*** the sum of Five hundred and thirty four pounds for her own absolute use I devise my messuage or tenement and premises situate in the Hight Street in the parish of Saint Nicholas in Colchester aforesaid now in the occupation of _George Farmer_ with the appurtenances and also my messuage or tenement and premises situate on the West side of North Hill in Colchester aforesaid now in the occupation of _Hatfield Wyatt_ with the appurtinances unto and to the use of my said niece ***Eliza Ann Barritt*** her heirs and assigns for ever I bequeath unto my nephew ***Alfred Cross*** of Ipswich in the County of Suffolk the sum of Ten pounds I also bequeath the sum of Ten pounds to each of the children of my niece ***Priscilla Barritt*** who may be living at my decease and attain the age of twenty one years And as to all the residue and remainder of my real estate whatsoever and wheresoever (except copyhold or customary hereditaments) And as to all the residue of my personal estate and effects of what kind soever I give and devise the same respectively unto and to the use of the said ***Joseph John Cross*** and the said ***Eliza Ann Barritt*** their heirs executors administrators and assigns according to the nature and quality thereof respectively Upon trust that they the said trustees or the survivor of them do and shall with all convenient speed after my decease sell dispose of all in and convert into money all the said residuary personal estate and effects and also do and shall absolutely sell and dispose of the said real estate And I direct the said Trustees or the survivor of them absolutely to sell and dispose of all the copyhold or customary hereditaments of or to which I or any person or persons in trust for me shall or may be seised or entitled at the time of my decease And I hereby further declare that the said trustees or trustee for the time being of this my Will shall stand and be possessed of the monies which from time to time shall come to their his or her hands or hand under and by virtue of the said residuary disposition subject to the payment and discharge of all my just debts funeral and testamentary expenses and the several pecuniary legacies given by this my will
Upon trust as to one moiety thereof for my said niece ***Priscilla*** the wife of ***Samuel Barritt*** for her use and benefit and as to the other moiety thereof Upon trust to be applied for the benefit and comfort of my Nephew ***James Barritt*** of Colchester from time to time and in such sums as my said niece ***Eliza Ann Barritt*** shall in her sole and uncontrolled discretion think fit and if there shall be any portion of such moiety unapplied at the decease of the said ***James Barritt*** then I direct the said ***Eliza Ann Barritt*** to lay out and apply the same in her discretion as aforesaid for the education comfort or maintenance of ***Herbert Charlton Barritt*** the son of the said ***James Barritt*** I devise and bequeath all estates which may be vested in me as a trustee or mortgagee at the time of my death unto and to the use of the said ***Joseph John Cross*** and ***Eliza Ann Barritt*** their heirs executors and administrators according to the nature and quality thereof respectively upon the trusts and subject to the equities affecting the same respectively I declare that any property hereby directed or authorized to be sold may be sold either together or in lots and either by public auction or private contract and with or without special conditions or stipulations relative to title or otherwise and the trustees or trustee making such sale may buy in any property put up for sale by auction or any part thereof and may recind or vary any contract for sale and may resell the property so bought in or the contract for the sale whereof shall have been so recinded as aforesaid without being responsible for any loss or diminution in price and may execute assurances give effectual receipts for the purchase monies and do all acts and things for completing any such sale which they he or she may think proper
And I declare that the receipt or receipts in writing of the said trustees or trustee for the time being for any money payable to them him or her by virtue of this my will shall be good and sufficent discharge for the same and that the persons to whom such receipt or receipts shall be respectively given shall not be answerable or accountable for the loss missapplication or nonapplication thereof or be in anywise bound to see to the application of the money in such receipt or receipts respectively acknowledged to be received Lastly I hereby revoke all former Wills Witness my hand the fifteenth day of June in the year One thousand eight hundred and seventy two
