Biography

Mary was born in 1856. She was the daughter of Michael Daley and Mary Kiely. She passed away in 1913. Divorce under BROOKER Mary Ann (Morgan) David (Morgan) Ref 1898/20 also 1910/129 Vic death reg no 10687. They had one Son, David Michael Morgan Brooker born 1885 in Fitzroy Victoria, Australia.

17 Nov 1910 THE AGE, MELBOURNE BROOKER V. BROOKER. Mary Ann Brooker, 53, of Nicholson-street, Carlton, sought a divorce from David Brooker, 61, on the ground of misconduct. The parties were married in Tasmania on 1st October, 1880, and there are five children of the marriage. Mr. L. &. Woolf (instructed by Messrs. Maddock, Jamieson and Lonie) appeared for petitioner, whose evidence was that in February, 1897, she left her husband's house on account of his unkindness and his admission of misconduct. She went to Western Australia, but on receiving a telegram telling her that her husband had met with an accident she returned and nursed him. In December, 1898, he turned her and her children out of doors. His Honour, after hearing other evidence, granted a decree nisi. The question of permanent alimony was allowed to stand over.

3 Dec 1910 TRUTH, Perth, W.A. Brooker v. Brooker. Mary Ann Brooker, otherwise Mary Ann Morgan, 53, of Nicholson-street, Cartlon, sought a divorce from David Brooker, 61, on the ground of adultery with a woman named Alice Hearle. The parties were married in Tasmania in May, 1880, and have five grown up children. Petitioner left for Westralia in 1897 on account of her husband's cruelty and his admission of adultery with the woman named, by whom he had a child. Some time afterwards he met with a serious accident, and she returned to nurse him. She instituted divorce proceedings in 1898, but withdrew them, and signed a deed of separation, in which it was covenanted that she should forego her claim for maintenance. They subsequently cohabited and put an end to the deed. The woman Hearle gave birth to a second child, of which defendant was the father. Petitioner sued him in the Brunswick Court for maintenance, but withdrew the case on a cash payment of £20 being made. Later on she obtained an order for 30s. per week in the Northcote Court, but it was upset on appeal, Judge Johnston holding that the covenant in the separation deed remained in force. The respondent was still living in adultery with the woman Hearle at McCracken's Avenue, Northcote. His Honor granted a decree. The question of alimony was reserved on the application of petitioner's counsel, who said respondent was a Brunswick property owner, and inquiries as to his means were being made.
