[image 585] 25 Jan 1760 – To Brother & Sister Sudrich and Sister Dunham and Cuson Ebenezer Davis Whereas our aged father Mr. Samuel Davis is Deseast and hes Left something of an Estate our Desire is that we may all Lovenly agree and enter into couenant that in the first place the estate may be seattled By Brother John Davis and that all the Lawfull debts to be paid out of the whole and that he should take good care of our aged and honored mother Mrs. Thankful Davis to see that she is well provoded for and hes good ... in sikns and helth and ater her desease and all necessery charges paid then what [...] estate shall be left of sd Deseast shall be equelly devided unto each of us .... I desire as I am the Eldest Son of Decd. Father Saml. Davis. And decline Executing his will in which I am named Executor I pray that I may be admitted administrator thereon Worcester March 5th 1760 [signed] John Davis

[image 573] 5 Mar 1760 – This letter is from Judge Chandler to all the Heirs of the estate of Samuel Davis late of Brookfield. He says that he has Samuel’s will in the office, but that John Davis, the only surviving executor, refuses to “accept the trust.” John has instead applied as administrator of the estate. He set a hearing for Monday March 17th, 1760 when the heirs could come to voice their opinion regarding the probate of the will and John’s administration. John Davis was directed to serve this notice.

[image 566] Account 1 Dec 1762 – The probate Judge assigned a three-man committee to make decisions about the division of the real estate: Jedediah Foster Esq, Capt. Thomas Gilburt, and William Ayers Esq. 12 Dec 1762 – The appointed men made oath to faithfully discharge their trust.

[image 565] 20 Dec 1762 – Report of the Committee that decided the division of real estate. They viewed 90 acres of poor land, without any improvements, and determined that it could not be divided without spoiling the whole. They set out the land to John Davis, administrator. There are to be 7 shares, 6 of which John has to pay. The heirs at law to the estate are: John Davis; Heirs of Benjamin Davis, deceased; Heirs of Joseph Davis, deceased; Heirs of Isaac Davis, deceased; Jemima Ayers; Thankful Sudderick; Mary Dunham.

[image 563] 30 Dec 1762 – Probate judge assigned all the land that Samuel Davis possessed when he died, about 90 acres, to his son John Davis. This was on the condition that John pays the other heirs. It was noted that Samuel Davis, the eldest son now deceased, received his portion during his lifetime. [see image 581]

[image 581] Receipt 16 Mar 1756 – Brookfield – Recd. of my Hand father Samuel Davis the sum fifty Pounds lawful Money as a Gift in consideration whereof I hereby acquit and release all Demands both for myself and my heirs upon my said fathers Estate.
