ZACHARIAH DAVIS, married ELEANOR ______ [HICKMAN?]; born ca. 1726; f. of Jean, James, Zachariah, Richard, Elizabeth (married ? Hickman), Agnes (married ? Gregory), Susanna (married ? Taylor), Judith, Martha (unmarried in 1800), and Lydia Davis (married ? Richey); probably born Virginia; he had patented 580 acres in Harrison County, Virginia, on 9 August 1787 (according to his will); will dated 6 February 1800-proved 13 October 1800, Franklin Township, Fayette County, Pennsylvania.

Zachariah Davis had a grandson who was at least 21 years old in 1800, when Zachariah made his will. The grandson was born by 1779, his father by 1754, his grandfather by 1729—probably earlier in each case.

WILL OF ZACHARIAH DAVIS

Will of Zachariah Davis[1] In the name of God Amen I Zechariah Davis of Franklin Township Fayette County State of Pennsylvania being weak in body but perfect mind and memory, thanks be unto God, Calling to mind the mortality of my Body and Knowing that it is appointed for all men once to die do make and ordain this my last will and Testament, that is to say principally and first of all I give and Recommend my soul unto the hand of Almighty God that gave it & my Body I Recommend to the earth to be Buried in Decent Christian Buriel at the descration of my Executors nothing doubting but at the General Resurrection I shall Receive the same gain by the mighty power of God. And as touching such worldly Estate where with it has pleased God to bless me with in this life I give, demise, and dispose of the same in the following manner and form. And first I give and Bequeath to Eleanor my dearly beloved wife the Plantation or tract of land whereon I now dwell Containing One hundred acres with the allowance situate and being in Fayette County Franklin Township State of Pennsylvania together with all the Appertainances thereunto belonging as also all my Goods & Chattles household furniture and moveable effects during the time she the sd. Eleanor shall remain my widow but if she doth change her widowhood It is my will that she have the third of the moveable effects, then it is my will that my well beloved daughter Jean Davis do immediately possess the above premises, but if my dearly beloved wife Eleanor shall & do remain my widow she shall have full possession as first above written during her natural life and at her decease it is my will that my dearly beloved daughter Jean Davis aforesaid do immediately possess the same during her the sd Jean Davis natural life and her the sd Jeans decease to the male heirs of her body begotten forever, but if the afforesaid Jean Davis shall have neither male not female Isue, then it is my will that my Grandson Zachariah Davis son of James Davis and Eleanor his wife do immediately possess the above tract of land during his natural life and at his decease to the natural heirs of his body begotten forever. Furthermore I do will and Bequeath unto my Loving Son Zachariah Davis the sum of Two hundred acres of land. It being part of a tract or Parcel of Land Lying and being Situate in Harrison County State of Virginia for which I obtained a patent Bearing the date the ninth day of August One thousand seven hundred and eighty seven. Containing five hundred acres of Land to him the sd. Zecheriah Davis to be freely enjoyed and Possessed. Also I do give & Bequeath to my son Richard Davis one hundred and fifty acres of said tract adjoining Zechariah Davis his two hundred aforesaid which is to Begin at the Beging Line on the East side of the Falling Run Richards one hundred and fifty acres shall join Zachariahs to the west. Also I give and bequeath to my Grandson Zechariah Hickman one hundred Acres of sd tract as near Square as may be to the west of Richard &c I also desire and it is my will that the remainder of said tract which is one hundred and thirty acres shall be equal divided in equal value Betwixt my Daughters, to Wit, Elizabeth Hickman, Agness Gregory, Susana Taylor, Judith Barnett, Martha Davis, By them and their Heirs to be Possessed forever. I also give & bequeath to my well beloved Daughter Lydia Richey the sum of eight Dollars which sum shall be equaly Raised & Levied out of my Estate I do Also Constitute & Appoint my well beloved wife Eleanor Executrix & Wm Wallis Executor of this my last will & Testament. And I do hereby Disanul and Disallow all former Testaments, Wills & Executors Ratifying and Confirming this and no other to be my last will and Testament in witness whereof I have hereunto set my hand and seal this twenty sixth day of February in the year of Our Lord one thousand eight hundred 1800 Zechriah Davis (seal)

Signed sealed Pronounced & declared by the said Zechariah Davis as his last will and Testament in the presents of us who in the presents of each other have hereunto subscribed our names. Robert Lynch Isaac Martin Wm Wallace Fayette County SS. The Thirteenth day of October Anno Domini 1800. Before me Alexander McClean Register &c. personally came Robert Lynch and Wm Wallis being duly sworn did declare and say they saw the Testator Sign and Acknowledge the foregoing to be his last will and Testament that he was then of disposing mind and not under undue influence to their Knowledge or belief and that they witnessed the same in his presence &c.
