From "Confederate Colonels: A Biographical Register" by Bruce S. Allardice, published in 2008:

Dyer, David - Born Dec. 28, 1823, VA. Farmer in Pittsylvania Co., prewar PVT in Mexican War. Md. Mary L. Davis (incorrect, should be Dews); Capt. Co. D 57th VA June 22, 1861 Major May 23, 1862 Lt. Col. 1862 (probably July 23rd) Col. July 30, 1862 Resigned January 12, 1863 due to ill health and pressure from his brigade commander who thought Dyer incompetent. Pittsylvania farmer post war. Moved to Corsicana TX (possibly around 1881 after wife's death)and Mayesville, SC later in life. Died May 5, 1899, probably in Mayesville.

Date of marriage - In his sworn application for Mexican War pension he (David Dyer) stated that he married Mary L. Dews on 2-19-1851 in Campbell County, Va. He also stated that Mary died on 12-8-1882 at Chatham, Va. (Pittsylvania Co.). - provided by Mike Bass

On January 27, 1870 it was reported in the Daily Dispatch, a Richmond VA newspaper that "David Dyer, of Pittsylvania, charged with carrying on a distillery without the proper license, and with the intent to defraud the Government of the tax on distilled spirits, was arraigned and found guilty. Sentence reserved." On February 10, 1870 it was reported in The Valley Virginian, a Staunton VA newspaper that "Col. David Dyer of Pittsylvania county, was found guilty of illicit distilling before the Richmond Court. The penalty is imprisonment in the penitentiary for a limited period of time." On March 9, 1870 the Daily Dispatch reported "Off to the Albany Penitentiary....David Dyer, of Pittsylvania....taken from the county jail yesterday and left on the James river steamer in custody of a deputy marshal for the Albany, New York, penitentiary."
