Biography

JOHN DIAS, son of Henry Dias and wife Mary (unknown maiden name), was born in Bath (later Beaufort) County, North Carolina, in about 1732 and died in Beaufort County about 1758.

John’s name first appears in his father’s will, dated 8 Dec 1737, probated in 1738. [1] He was the youngest of five children, and his father was a widower. Rebecca Pursell, Henry’s sister, was co-executor of the will along with her husband John Pursell.

On 15 Feb 1740 Rebecca Pursell petitioned the North Carolina Governor’s Council to grant a warrant for the land bequeathed to John in Henry’s will. Henry had not patented the land before he died and John was a minor. James Rigney had improperly obtained a patent to the detriment of John, the rightful heir. Warrant was granted. [2]


On 12 Dec 1749 a guardianship bond was issued obligating Jacob Johnson to be responsible for the care of John Dias, who was still a minor.[3]


The 1755 tax list shows John Dias living with John Slade and two negroes. (For tax purposes, this schedule only includes white males age 16 and over and blacks.) [4]

Beaufort County Court minutes, March Court 1758: Thomas Lee, Administrator for the estate of John Dias moves for the sale of the perishable parts of the said deceased, whereupon it is ordered that the estate be sold at public vendue on the first Friday of April next and that the said sale be advetised according to law.[5]

Beaufort County Court minutes, June Court 1758: Richard Flannakin exhibited in Court on oath and account sales of sundries, the estate of John Dias, decd. Ordered to be recorded in the Orphan Book. .[6]

I don't think the Henry listed is the correct father for John. From a database that a bunch of Dyess researchers have studied is that the parents are William H. Dyess (abt 1717, SC - abt 1811, Stewart Co., GA) and Mary (abt 1708, Bath Co., NC - abt Dec 1732, Bath Co., NC). They also have parents beyond William as he's one of six brothers who came out of Barnwell, SC. :)

Dyess-49 and Dyess-21 do not represent the same person because: Henry Dyess 49 is the father of John Dyess 21.
