He wanted to put up a partition fence between the lots. John & Alphonso Elliot refused to divide the line where the fence ought to be built or to build a fence on their part of the line. Daniel requested the fence viewers to divide and assign the land as provided by law. The fence viewers marked where Alphonso, Daniel, and John were each to build and maintain a fence, giving them 10 days to do so.
