wife H. V. Burgess, A.C. Burgess & wife M.E. Burgess, vs. Charles G.
Whitehead, Sarah E.Vestal, Araminta J. Vestal, Mary E. Vestal, Nancy C.
Vestal, Daniel K. Nelson & wife, Sarah E. Nelson.
Your petitioners by their petition respectfully represents,
I. That Price Vestal Late of said County (Randolph) died intestate therein
about the month of November 1882. Leaving him surviving your petitioners C.M.
Vestal, Pyrena E. Ferguson, Nannie J. Johnson, H.P. Burgess & M.E. Burgess,
and the defendant Sarah E. Nelson, his children, & the defendants Charles G.
Whitehead, a son of his deceased daughter Artilla A. Whitehead, and Sarah
E.Vestal, Araminta J. Vestal, Mary E. Vestal, & Nancy C. Vestal, children of
his deceased son, William E. Vestal, his grandchildren, his only heirs at law
upon whom his real estate descended at his death to be divided between them
as tenants in common, each of the Children being entitled to one-eighth part
thereof, and each one of the grandchildren entitled in the share of his
parents according to their number.
II. That the said intestate at the time of his death was seized in fee
simple of the Following lands to wit, an undivided two thirds of a tract or
lot of land, situated in said County of Randolph, in the village of
Columbia, adjoining the lands of the Deep River Manufacturing Company &
Others, the other third being owned at the time of his death by your
petitioner C..M. Vestal in fee simple; Also one other lot of about one acre,
situated in said County, in said Village of Columbia, adjoining the land and
lots of M.C. Free, John Steel & others.
III. That your petitioners desire to have partition of said lands according
to their respective rights and interests therein.
IV. That the defendants, Sarah E. Vestal, Araminta J. Vestal, Mary E.vestal,
Nannie C. Vestal live in Texas County, Missouri; and Daniel K. Nelson & wife
Sarah E. Nelson, live in Wayne County, Indiana; And that each of said
defendants are non residents of the state of North Carolina, and after due
diligence cannot be found therein.
V. That the defendants Charles G. Whitehead, who lives in Randolph County,
N.C. and Sarah J. Vestal, Araminta J. Vestal, Mary E. Vestal, and Nancy E.
Vestal are all minors under the age of 21 years, and without regular guardian
in North Carolina.
VI. That all the defendants have failed to come forward and join in this
petition.
Wherefore your petitioners pray the Court to order a sale of the whole said
tracts,
That a summons be issued to and served upon all the defendants, and
publication made for the non resident defendants, according to law,
commanding them to appear and answer.
That a Guardian ad liten be appointed for the minor defendants to defend this
action in their behalf, and be served with summons.
For all such other and further relief as he may be entitled to. M.S. Robins,
