His first wife was Alice Booth (alias Bothe).[1][3] They were married between 1416 and 1424. She was the daughter of Henry Booth of Arleston,[3] & Sinfin, Derby (d. 1446).[2][9]
in 1416, Alice's father, "and John de la Pole obtained the wardship and marriage of the young Nicholas Fitzherbert, for which they agreed to pay £40 ... Booth eventually arranged a marriage contract between his daughter, Alice, and the boy, whose main estates lay in Norbury in Derbyshire. Twice, in 1424 and 1437, our Member actually presented to the local parish church in the place of his son-in-law, in whose affairs he was closely involved. This valuable wardship had belonged initially to Henry V, who, in his capacity as duke of Lancaster, sold it to the two men."[2]

Nicholas Fitz-Herbert of Norbury, knight of the shire for Derby, in 1434, 1446, and 1452, and sheriff for that co in 1448 and 1456. He m. 1st Alice, dau of Henry Booth, of Harleston, in Derbyshire, and had with five daus, five sons, Ralph. his heir, John of Etwall, Remembrancer of the Exchequer, Robert, ancestor of Fitzherbert of Gatesbury and Ephall, Herts, Roger, and William. Nicholas FitzHerbert m. secondly Isabel Ludlow of Stokeshay, in Shropshire, and had two other sons, and two daughters. He d. 19 Nov 1473, and was s by his eldest son,
