Biography

Luke had a brother Bartholomew, as is shown by the 1839 will of one of Bartholomew's grandsons, Bart Deweese, which identified Christopher Foley, son of Luke, as Bart Deweese's cousin.

1765 - Luke bought land in Mecklenburg Co., VA, which adjoined Pittsylvania [which included present day Henry and Patrick counties) to the east:

Mecklenberg Co. was just east of Halifax, east of Pitts., east of Henry, east of Patrick.

8 Jul 1765 - Luke Folio - Mecklenburg Co., VA - 398 acres purchased from William Wilkins for 22 pounds.

Nov 1767 - Both Luke and Bartholomew bought land in what later became Patrick Co., Virginia. At the time it was in Pittsylvania county:

[From researcher J.T. Foley] "Luke and Bart were brothers, they both claimed free land in the western territories of Virginia beginning in 1767 and continuing until 1768. Many of their claims are on adjoining pieces of property and as some of the claims and later deeds list the others' shared property line, they were definitely of the same generation. Luke was in Mecklenburg Co., VA as early as 1765, but both he and Bart bought land inland that later became Patrick Co., VA in 1767. Puppey Creek is in Patrick County. At the time of the land claim it was part of Pittsylvania, but as the settlements moved westward they split off counties from Pittsylvania. Henry County was formed from Pittsylvania in 1776, then Patrick was formed from Henry in 1791. So the Foley's weren't moving, the county names were changing where they were living as the state became organized in the western parts of Virginia."

They bought land in 1780 on Goblingtown Creek. They bought more land in 1781 and 1789 on Goblingtown and Sycamore Creeks and were next door neighbors to Luke's brother, Bartholomew and his wife Barbara:

A George Foley who may have been a son, nephew, or brother served in the Henry Co., VA militia in 1781 along with Luke's brother Bartholomew, in Capt Thomas Henderson's Company and in John Nevil's.

John Nevil's wife Sarah 25 Jul 1782 had land on the line of Luke Foley, Thomas Morrison, and a Ward. George Foley had been in Nevil's company in 1781.

9 Apr 1785 John Henderson witnessed Luke Foley's line. That same year, Luke witnessed John Henderson's will. Henderson died 1794 and Charles Thomas and George Hairston administered estate.

This record from 1787 looks like some kind of vote. Some of the names have the word "disputed" after them, so apparently all identities and the right to vote were checked. All names are numbered:

Land records indicate that Bartholomew and Barbara were near neighbors of John Burnett and Humphrey Smith on Sycamore Creek. Luke and Mary had land on Goblingtown, Sycamore, and Little Sycamore Creeks:

19 Apr 1794 Luke Foley to Jacob Saunders 1/200 for 15 pounds, a certain tract of land in Patrick on the waters of Little Sycamore Cr, containing about 170 acres, and bounded by Wm Isham, Luke Foley, Thomas Morrow. Recorded 28 Aug 1794 Wit: Wm J Mayo, Major Hancock, Val. Mayo.

17 Mar 1798 Luke Foley to John Burnett 1/493 Deed for 15 pounds, a certain tract of land in Patrick on the waters of Goblintown Cr, containing 346 acres, and bounded by Adams' order line. Wit: William J. Mayor, Cornelius Burnett, George Crawford. Recorded Mar 1798

Luke's brother Bartholomew died in 1794.

26 Dec 1796 - One of Bartholomew's daughters, Eleanor "Nellie", sold the land she had inherited from Bartholomew's estate to neighbor Humphrey Smith, who by now was executor of her brother-in-law Cornelius Deweese's estate. Luke witnessed the deed:

"Relinquishment by Elenor Foley, one of the heirs of Bartley Foley, deceased, and have this day sold to Humphrey Smith all and singular my right, title and interest in and to all the lands and tenements which the said Foley died seized of for value received and do hereby relinquish all claims to his estate. Dated December 26, 1796. Signed Elenor Foley Witness David Harbour Sr., Luke Foley, Olevia Smith."

20 Aug 1800 Luke Foley to Rowan & Scott 2/24 Deed

Luke died sometime between 20 Aug 1800 and Apr 1801, when his and Mary's daughter married and was identified on her marriage bond as the "daughter of Mary."

On 26 Aug 1802, Luke and Mary's daughter Mary sold land:

Aug 1805 - Mary and her son Christopher and son-in-law James Moles sell a tract of land. Why was James Ferrall included on this deed? He was married to Margaret Sharp, daughter of William Sharp:

AUGUST COURT 1805 (29 August 1805) Present: Samuel Packwood, Brett Stovall, John Hughes, Robert Sharp -- Gentlemen Justices A Deed from Joseph Reynolds to Richard Sharp acknowledged & O.R. Also a Deed from James Farral to the same, Proved by 2 Witnesses & O.R. Also a Deed from James Moles, Mary Foley, Christopher Foley and James Ferrall to the same [Richard Sharp]. Proved by 2 Witnesses also & Ordered to be Certified.

"The Widow Foley" referred to below may have been either Mary, widow of Luke, or Barbara Sr., widow of Bartholomew:

NOVEMBER COURT 1805 (28 November 1805) William Sharp Sr. is appointed Surveyor of the road in the Place of Richard Sharp from the top of the Bull Mountain below the said Sharps Place up to the ford of Sycamore at the Widow foleys, and the list filed be his Gang. Major Hancock is Appointed Surveyor of the road from the top of the Bull Mountain to the Branch at the lower(?) end of Foleys old Field, & the list filed be his Gang.

In 1810, only two Foleys were listed on the Patrick Co., VA tax list, although there were several others in the county. They were Luke and Mary's son Christopher, and Gabriel, who was likely a grandson of Luke's brother Bartholomew, but may have been Luke and Mary's grandson. He would change his name to Gabriel Bowling:

In all subsequent years, Gabriel was listed as a Bolling.

Luke and Mary's son Christopher fought in the War of 1812, as shown by this affidavit he signed in the 1853 pension application of Pena Sharp, widow of Robert Sharp. Christopher is unable to even sign his name, which might be an indication of the educational level of the rest of his family, as well:

State of Virginia, County of Patrick SS "On this the 11h day of [month of "November" is blotted or crossed out] AD 1853 personally appeared before me William Critz Jr. a Justice of the peace in and for the county and state aforesaid Christopher Foley who being first duly sworn on his oath declares that he enlisted under Abram Penn a captain in the late war with Great Britain on or about the 1st day of August AD 1814, that he left the county of Patrick in the state aforesaid on the said 10th day of August 1814 that he was in the seventh regiment of Virginia militia commanded by one Saunders (whose name this affiant does not now recollect)..." test his John T. Noel Christopher (X) Foley mark

1813 - Luke's old land was mentioned in a deed:

1813 Jun 26 - Patrick Co, VA - Deed Bk 4:19-20; Recorded: Oct 1813: JAMES HALL to MARTIN JOHNSON.. 261 acres being part of land that JOHN BURNETT bought from Luke Foley on waters of Goblintown Creek [& Smith River] including the plantation where MARTIN JOHNSON NOW LIVES. Wit: GERMAN BAKER, GREENVILLE PENN, DAVID ROSS, JOHN HANCOCK. James Hall moved to Howard Co, MO where he died.

By 1820, Mary seems to have been living with son Christopher. Although it's possible that this was his mother-in-law or someone else, the fact that she deeded land to him the next year indicates it was probably her:

Mary apparently died sometime between 1830 and 1840.


No list of Luke's or Mary's heirs has been found, but the following children may be surmised:

1. George Foley?

A George Foley who may have been a son, nephew, or brother served in the Henry Co., VA militia in 1781 along with Luke's brother Bartholomew, in Capt Thomas Henderson's Company and in John Nevil's.

John Nevil's wife Sarah 25 Jul 1782 had land on the line of Luke Foley, Thomas Morrison, and a Ward. George Foley had been in Nevil's company in 1781.

This George has not been further identified.


2. Bartholomew or Bartlett Foley, Jr.?, b.c. 1765.

This Bartlett Foley may have been the son of either Bartholomew/Bartlett Foley Sr. or of Luke. However, if he was Bartholomew Sr.'s son then he apparently died before his father's death in 1794 without leaving heirs.

He was of voting age in Apr 1787 and listed along with Luke and Luke's brother Bartholomew on a list of voters in Henry Co., VA:

In addition, there is a second record of a Bartlett Foley who seems to have been living least nine years after Bart Sr.'s death. This would seem to argue that he was Luke and Mary's son:

SEPTEMBER COURT 1804 - (27 September 1804) Patrick Co., VA: Wm. Sneed & his Gang is to be considered as Oversaer(?) of the New Road from Silas Ratliffs into the near Bartlett Foley & it is Ordered that they do clear and keep the same in repair according to law.


3. Jeremiah Foley, Sr., b.c. 1765-1770; m.c. 1789, Patrick Co., VA to his first cousin Barbary Foley Jr. [b.c. 1770; d. 1834, Patrick Co., VA; daughter of Bartholomew Foley Sr. and Barbara __]; he d. 1809-1820, Patrick Co., VA.

There is no documentation of Jeremiah being the son of Luke and Mary, but he couldn't have been the son of Bartholomew and Barbara.


4. Patrick Foley?

Patrick Foley gave bond for the marriage of Jeremiah and Barbara Foley's daughter Leona in 1818 in Patrick Co., VA. No further record has bee found of him. It's possible that Jeremiah and Patrick were the same person, or Patrick may have been another son of Luke and Mary's.


Most of the information on daughter Mary was provided by researcher Elaine Pfitzer:

5. Mary Foley, m. Barnabas Kelley [b. by or c.1760; d. by 1828];

1782 Henry Co, VA tax list, where Barnabas paid one poll and tax on one horse.[iii] Among those on the same 1782 list were Luke Foley and Richard Pilson.

Patrick Co., VA court - AUGUST COURT - (26 August 1802) Order Book 2, pg 7 "A Deed from Mary Kelley heir at Law of Luke Foley Decd. to J. Saunders further Proved and Ordered to be Recorded."

"Heir at law" means one entitled to inherit property from a deceased person by law when a will hasn't been found. This Mary could have been either Luke's widow Mary or a married daughter. The argument against it being his widow Mary is that she continued to be referred to in legal documents after this date as Mary Foley.

Patrick CO VA, Deeds, 1828-1835, Vol.7-8, Book 7, Page 20: April 8, 1828. "Articles of agreement between Thomas Kelly of the one part and John Kelly of the other part (both of the county of Patrick and State of Virginia.) Witnesseth that where as the said Thomas Kelly being the lawful heir of Barnabus Kelly deceased and he having as his believes and unequitable title to these tracts of land lying in the county of Patrick of which the said Barnabus Kelly otherwise a right by his intermarriage with Mary Foley late of this County and daughter of Luke Foley deceased. He the said Thomas Kelly doth hereby authorise and permit the said John Kelly his brother to employ council in the name of said Thomas, sue for and recover the aforesaid tracts of land or either of them as he may be advised, and if he should recover the said land or any part therof the said Thomas doth hereby for himself and his heirs relinquish to the said John Kelly and his heirs all the right and title which he may have thereto in ___? of his being the lawful heir of Barnabus Kelly deceased and more over he doth oblige himself and his heirs after the recovery of the said lands to make the said John Kelly or his heirs a good and lawful deed to the same under the penalty of five hundred dollars. In testimony where of the said Thomas Kelly hath here unto set his hand and seal this 8th day of April 1828." Signed his mark, Thomas X Kelly. An 1828 deed from Patrick Co, Va mentions that Barnabas was from Franklin Co, VA. (Note: Franklin Co was formed in 1786 from Bedford and Henry Counties).

"Articles of agreement on this day entered into between Mary Kelly widow of Barnabus Kelly deceased of the county of Franklin of the one part and John Kelly of the County of Patrick of the other part. Witnesseth where as she said Barnabus Kelly at his death had good title to these tracts of land situated lying and being in the county of Patrick, which title he acquired by his intermarriage with his wife who was the daughter of Luke Foley deceased. Now the said Mary Kelly on her part doth hereby relinquish to the said John Kelly her son all the rights and dower which she hath in and to the aforesaid tracts of land either in law or equality, the said Mary Kelly doth hereby authorize John Kelly to employ council if necessary and sue to recover the said tract of land, or either of them, or any part there of and said Mary Kelly doth hereby relinquish to him the said John Kelly and his heirs all the rights and title, interest and claim which she have thereto or otherwise and more over of the said John Kelly or his heirs, exectors or administrators shall receive the said tracts of land or either of them or any part thereof, this the said Mary Kelly doth hereby oblige herself her heirs under the penalty of five hundred dollars to make him the said John Kelly or his legal representative a good and lawful right to the same against all persons claiming ___? her. "Articles of agreement this day entered into between Richard Kelly and Rebecca Kelly children and heirs of Barnabus Kelly deceased both of the county of Franklin of the one part and John Kelly of Patrick County of the other part. Witnesseth that where as the said Barnabus Kelly deceased at his death had legal title to three tracts of land lying in the county of Patrick which title he acquired by his intermarriage with his wife who was the daughter of Luke Foley deceased. Now the said Richard and Rebecca as heirs of the said Barnabus Kelly deceased do hereby arthorize and permit the said John Kelly their brother to employ council in their names if necessary, sue for and recover the aforesaid tracts of land or either of them or any part thereof - and they do hereby relinquish to him the said John Kelly and his heirs all the rights, title or claim which either of them or thier heirs have thereof either or heirs of the said Barnabus Kelly deceased or otherwise. And moreover if the said John Kelly, his heirs, exectors or ___? administrators shall recover the said tract of land or either of them or any part there of thenthe said Richard and Rebecca Kelly do hereby oblige themselves, their heirs. And under the penalty of five hundred dollars each, to make to him the said John Kelly or his legal representation a good and lawful right to the same all persons claiming heirs. Patrick CO VA, Deeds, 1828-1835, Vol.7-8, Book 8, Page 160: Feb 6, 1833. "We Richard Kelly, Nelly Kelly, Kelly heirs and distributies of Luke Foley deceased do oblige ourselves our heirs and to make James Branch of Patrick CO VA his heirs __ a good and lawful right and title to a certain tract of land lying and being in this county of Patrick on the waters of Sycamore Creek and North Mays River containing four hundred acres more or less, and under the penalty of four hundred dollars. In testimony where of we have here unto at our hands and seals this 6th day of Feb 1833." Richard Kelly Nelly Kelly witnesses: Joseph P. Terry, Henry B. Terry, Wm McGhee. Patrick Feb. In 1854, Carter Co, TN, John Kelly, brother of Julia Ann Kelly Hunt, and son of Thomas Kelly, gained power of attorney regarding some land that belonged to his father. This land was the same that Thomas had inherited from his father, Barnabas, in Patrick Co, VA. The document makes mention of Surry NC. [xv]

Barnabas Kelly of Surry Co, NC Barnabas Kelly was found on both the 1790 and 1800 Surry Co, NC census. He is the only Kelly in Surry in 1790. In 1800 there were three Kellys in Surry: Barnabas, Joseph, and John. John Kelly was from Maryland, and no connection has ever been made between him and the other two Kellys. Unfortunately, the 1800 census is in alphabetical order, and it is impossible to determine the area where Barnabas was living. The 1790 census is in a sort of rough alphabetical order by district. Charlie White kindly determined that Barnabas was somewhere in or near the Deep Creek area. On the Surry tax list of 1800 Barnabas is listed with 88 acres; no watercourse or other location is given.

1790 Surry NC census 2 males of 16 and up, 1 female 1800 Surry Co, NC Census 1 male 45 and over, 1 female 10-15, 1 female 26-44 NOTE FROM KIM: From this census, Barnabas was at least 45, which would make his birth year about 1755. He could have been older.

Mary Foley Kelly's children (maybe others):

1) Thomas Kelly, born about 1784, and died between 1838-1854. He married Elizabeth Hunt. Their daughter, Julia Ann Kelly, married John Brooks. Elizabeth Hunt was the daughter of David Hunt. David Hunt was found in Surry NC census, deed, and will records, and was listed in Davis' District, 1820. He was married to Juliatha (various spellings).


NOTE FROM ELAINE PFITZER: "Elizabeth Hunt Kelly, wife of Thomas, died after 1829 and before 1837. She and Kelly children are mentioned in the Will of her father, David Hunt, 1829. Thomas and Elizabeth Hunt Kelly's children were: Richard b. about 1811, Julia Ann b. about 1812 and d. Dec 1870, Grayson CO TX, John b. June 11, 1830 and d. Feb. 18, 1917, Rowan CO KY, David, Hannah/Hanner, And a Rebecca has also been mentioned. The Power of Attorney said 5 heirs and gave no names except John. I [Elaine Pfitzer] am thinking the Rebecca could be part of Hannah's name."

2) John Kelly
