Death occurred before the Union siege of Port Hudson began May 21, 1863. The Union siege of Port Hudson was conducted from May 21 to July 9, 1863. 862, the 48th Inf Regt was garrisoned at Camp Hill, Mississippi and there were no Union forces in the area. The unit was mustered at Nashville, but was ordered to Corinth, MS before the muster was complete. Research notes of Stella Faye Clement Martin indicate his family at home in Tennessee was notified that he died 18 April 1862 and was buried at an unknown location on a bank of the Misissippi River.
In an interview with Stella Fay (Clement Martin), Vera Gertrude (Winn) Martin in 1970, Vera indicated her grandmother received notification of his death due to Typhoid Fever and that he was buried under a tree the bank of the Mississippi River. Death occurred before the Union siege of Port Hudson began May 21, 1863. The Union siege of Port Hudson was conducted from May 21 to July 9, 1863.
There are no CSA records of courts martial and confinement of a James A Foster.

From records available during that time period, it appears that Private Foster had never participated in an engagement. The unit's first engagement was at the Battle of Farmington Road, May 28, 1862 after his death. It is, therefore, unlikely that he was interned at any military prison, Union of Confederate.
