By 1840 he has moved to neighboring Marshall County, Tennessee[4] where they again appeared on the 1850 census.[1]
The 1850 agricultural census schedule for Marshall County, Tennessee shows Mitchel owned 25 acres of improved land and 30 acres unimproved and that his farm was valued at $1,000 that year and that he owned 5 horses, 3 milk cows, 2 oxen, 2 other cattle, 5 sheep, & 36 swine, animals valued at $700, and that his farm produced 700 bushels of Indian corn and 70 bushels of oats.[5]
Mitchel died sometime between 1850 and April 1857 in Marshall County, Tennessee[6] where he is last found living in 1850[1] and where his wife and younger children are in 1860.[2] He does not appear on the 1849-1861 wills indexes in Marshall County, Tennessee, so he apparently died intestate[7] as on 07 April 1857, in Marshall County, Tennessee County Court, Nancy Franklin, widow of Mitchel Franklin, petitioned the court for a years provisions for herself and her family,[6][8] and on 01 Jun 1857 the court noted she was provided with 10 barrels of corn, pounds of bacon, 75 pounds of lard, 100 pounds of coffee, 50 pounds of sugar, 350 pounds of salt, 200 pounds of flour, 3 pounds of pepper, 1 pound of spice, 1 pound of ginger, 5 pounds soda.[9]
