Biography

Clive Gallagher has Irish ancestors.

Clive was born in February 1914 at Hughenden, Queensland. He was the son of Marcus Gallagher and Margaret Heffernan and twin to brother Harry.

His main school education was conducted at Convent School, Mackay, where in December 1932 he successfully completed and passed Standard IV.

In December 1932 he was also appointed to the Department of Labor and was transferred to the town of Ayr from where he was residing with his parents in Mackay. He transferred from Mackay to Toowoomba in mid/late 1933, initially living at 140 Perth street. During this time and the next few years he continued to play rugby union for Catholic Club, Mackay. From 1936 to enlistment in the army, he was living in Toowoomba in Hume Street.

Clive enlisted in the Australian Army 23 June 1940, serving until September 1945 and attaining rank of Sergeant.

His initial unit was 9 Rec. Sec., 2/3 A. FO W/S. He embarked 27 December 1940 from Sydney, arriving and disembarking in Suez 31 January 1941. On 10th March 1941 while serving in Egypt, Clive was injured with a possible broken ankle at Gaza Ridge and transferred to the 1st Australian General Hospital. The next day, 11 March, he was promoted to Corporal, then 12 days later on 23 March, to Sergeant. He was discharged from hospital and rejoined his unit 25 March 1941. He embarked from the Middle East 31 January 1943, arriving in Sydney and disembarking 27 February 1943.

In June 1943 he was transferred to 2/101 Australian General Transport Company, which in January had returned from the Middle East. Clive married in July 1943 to Enid Josephine Hart. In Clive's military records, at the time of marriage Enid's address appears as Court House Hotel, Margaret Street, Toowoomba. Within a week of marrying Enid, on 13 July 1943 Clive was dispatched to Port Moresby in New Guinea with the 2/101 AGT Co.. On 22 February 1944 Clive was concussed and admitted to 2/5 Australian General Hospital. He was discharged to NGDD March 1944, then shipped back to Australia, disembarking at Townsville 30 May 1944. He then remained in Queensland for the duration of the war, a notable event being that he went AWL 17 - 19 August 1945. He was finally discharged in September 1945.

The Gallagher family book indicates that Clive and Enid divorced in 1945/46, and this may have been related to the time he was discharged from the Army and may also be related to his AWL incident.

By 1949 he was living at 24 Arran Ave, Hamilton, his previous recorded address in 1943 electoral records being 163 Hume street, Toowoomba.

He was Deputy Bailiff to the Magistrate's Court in Brisbane in 1952. He took a beating on attempt to recover assets from a fumigator under a court order and took the offender to court for assault. In May 1952 he was reported in the Court proceedings as living at Edmonstone Street, South Brisbane.

Clive moved from Brisbane somewhere between 1952 and about 1954 (absence of registration in electoral roll records after 1949, and does not appear in them for 1954).

The Gallagher family book indicates that Clive disappeared from family contact and his whereabouts / death remains unknown.

He is now (09/04/2020) confirmed buried at Moulamein Cemetery, Wanganella Moulamein Rd, Moulamein, New South Wales, Australia. This is confirmed via his military identification number being posted on his grave.

Personal correspondence with the Murray River Council received 12 April 2021 confirmed : “ Clive passed away on the 19th of November 1991 & was then Interred on the 26th of November. He was Interment number 336 and was buried in the location highlighted in Green on the map below, which is the Catholic section of the cemetery.”

His death is recorded in Victorian BDM Records. This record suggests that place of death was at Manangatang, Victoria, located to the west of Moulemain and to the north of Lake Tyrell. [1]

There do not appear to be any other records of Gallaghers buried at Moulamein, and therefore is assumed that Clive did not remarry. This presumption is validated in that his death registration indicates spouse at death being Enid (even though she had passed away on 20 August 1958).

2/101 AGT Company History (Excerpt) https://www.awm.gov.au/collection/U56360 The 2/101st left Alamein in December 1942 and went to Gaza, Palestine, where it participated in the 9th Division's parade on 22 December. In January 1943 the company left Palestine for the Suez Canal and boarded the troopships for Australia.

On its return to home in 1943, the company was based at Grovely, Brisbane, before being sent to Port Moresby, Papua, in July. New Guinea's terrain and limited infrastructure made transporting and resupplying the Allied forces by road difficult and much of this work had to be done by air. Many men from the 2/101st volunteered to work as crews on transport aircraft, on C-47 "biscuit bombers" - dropping supplies to the forward units "was a very exciting experience". At the end of May 1944 the 2/101st returned to Queensland, based at Warwick and then Petrie.

In March 1945 the company moved to Morotai, in the Netherlands East Indies (now Indonesia). The Allies used Morotai as a base for the American operations in the Philippines and the Australian operations on Borneo. The 2/101st remained on Morotai until after the end of the war, at which time it returned to Australia.

A team representing the Mackay Junior Cricket Association journeyed to Sarina on Sunday last to try conclusions with a team representing the Country Association's No. 2 team and was defeated by 16 runs. A brilliant batting display was given by Clive Gallagher, who is a son of our worthy Police Magistrate, in compiling 51 runs. A Sarina enthusiast was so enraptured with his batting that he likened him to Macartney.

Clive Gallagher, who recently was transferred from Mackay to Toowoomba, has settled down to form with the bat. Playing for Brothers, he top scored with 45 out of a total of 189. In a match against Bell, a country town, he scored 64, including three 6's off successive balls from the fast bowler. When in Mackay, Gallagher who is in his early 20's, showed promise as a punishing left-hand bat, and during the last Easter carnival he scored a rapid century. He did not appear to take the game seriously, however, and did not play this season before leaving for Toowoomba. The previous season he played with Catholic Club and had a number of good scores to his credit. He on-drove and straight-drove powerfully, and had a partiality for putting the ball over the boundary.

Failed Peanut Farming Venture Dispute

The Telegraph (Brisbane, Qld. : 1872 - 1947), Thu 28 Feb 1935, Page 11 Peanut Share Farm Dispute TOOWOOMBA February 28. In the Toowoomba Magistrates' Court to-day, before Mr. Marcus Gallagher, Police Magistrate, Clive Edward Gallagher, of Toowoomba, sued Mrs. C. Crittenden, of Toowoomba, for breach of agreement. Mr. E. W. Cleary appeared for the plaintiff, and Mr E. Lavers for the defendant. Mr. Lavers, for the defence explained that Mrs. Crittenden had arranged for the plain- tiff to farm 10 acres of peanuts on a share basis; she to provide the land and implements. The defendant alleged that some time after the work had been commenced she discovered that the plaintiff was not a practical farmer, and the work he had done was valueless. The plaintiff in evidence stated that his employment for some time before the peanut venture had been in wireless circles, but that he had had farming experience, and was a practical farmer. He had learnt about peanuts from a Mr. Sweeney between 1933 and 1934. Subsequent negotiations between Mr. Sweeney and the defendant led to his essay in peanut farming. The defendant, Mrs. Crittenden, was also to pay rates and taxes on the land, to provide for payment of extras later, if necessary and to arrange with Mr Sweeney for the marketing. The case is part heard.

The Telegraph (Brisbane, Qld. : 1872 - 1947), Tue 12 Mar 1935, Page 2 CLAIM FOR £175 Alleged Breach of Agreement, Peanut Growers in Court TOOWOOMBA, March 12. In the Magistrate's Court this morning the hearing was commenced of a case in which Clive Gallagher, of Perth Street, Toowoomba. is claiming £175 from Mrs. C. Crittenden, of Middle Ridge, for alleged breach of agreement. The plaintiff alleges that he agreed to plant 11 acres at Middle Ridge with peanuts, and the defendant was to supply the tools and any extra labour which might be required, and that they would share the profits. The defendant claims that plaintiff was, not a practical farmer. Mr. E. W. Cleary represented the plaintiff, and Mr. A. E. Lavers the defendant. Mr. M. Gallagher, Police Magistrate, was on the bench. Robert Thomas Gaul said that he had been growing and selling peanuts for the last six or seven years. He saw the paddock at Crittenden's place being cultivated and it appeared to be in first class condition. He Inspected the paddocks about February 25 or 26 and it was covered with summer grass, which would choke, and stunt the growth of the peanut plants. DEFENDANT'S EVIDENCE. Mrs. Elizabeth Crittenden, Ramsay Street, Middle Ridge, said that the plaintiff came to her place with Sweeney, but she had not approached him to share farm on her property. Sweeney said that the plaintiff was a capable farmer, and plaintiff informed her that he was an experienced peanut grower. He later came out by himself and discussed the project with her. They came to terms, and. she agreed to supply the tools and seeds, and they were to share the cost of any extra labour required. Plaintiff was to devote his full time to the job. After the land was ploughed, she saw weeds on the ground, and she spoke to the plaintiff about it, and he replied that he was going to scuffle them out. NOT A FARMER. She said to plaintiff, "You are not a farmer." He replied "No." She said that the plaintiff finished planting on December 3 and did not return to chip the weeds. On December 11, witness said, she went to the Queensland Trustees and got the secretary to write a letter to the plaintiff, who came out next day, and would not leave for some time. She since has had a small part of the land cleared, but it was too expensive to do the whole of it, and the nuts were not worth pulling because they had not been properly looked after. Proceeding.

Assaulted Executing Court Warrant

Brisbane Telegraph (Qld. : 1948 - 1954), Wed 14 May 1952, Page 13 CLAIM BAILIFF WAS ASSAULTED A man was charged In the Police Court today with having assaulted a bailiff. He is Clarence Miller, fumigator, of Cribb Street, Milton. Miller was charged on summons before Mr. McKenna, S.M.. with having unlawfully assaulted Clive Gallagher on May 6 "while he was engaged in the lawful execution of the process of the Magistrate's Court against certain property." The complainant, Gallagher, was listed as Deputy Bailiff of the Magistrate's Court on the summons. At the request of Sub-Inspector Risch the case was adjourned until May 21. On the application of Mr. A. Hopgood (for Miller) bail of self , in £40 was granted.

The Courier-Mail (Brisbane, Qld. : 1933 - 1954), Thu 29 May 1952, Page 9 DEPUTY-BAILIFF AS COMPLAINANT Assault denied Clive Gallagher, Magistrate's Court deputy-bailiff, had been assaulted, it was claimed in the Police Court yesterday. Clarence Miller, of Cribb Street, Milton, contested a summons charge of having assaulted Gallagher, who was engaged in the lawful execution of process of the Magisrate's Court against certain property. He also contested a charge which set out that a utility truck had been attached by Gallagher in a process of the court — a warrant of execution against Miller's land and goods — and that Miller, while it was in Gallagher's custody, had retained it with intent to defeat the attachment. Detective Sergeant F. J White said Gallagher alleged that Miller had struck him on the nose, face, and back of the head with his fists at the Regatta Hotel on the night of May 6. White said that Miller had denied having assaulted Gallagher, or having ever seen him. Had broken nose Dr. G. B. Roberts said that when examined at the General Hospital Gallagher had a broken nose, and a laceration on the upper lip and right wrist. Dr. Roberts told Mr. E. Duncan (for Miller) that Gallagher could have received his injuries by falling downstairs. Hearing was adjourned until to-day. Miller was also remanded until to-day on a charge of having wilfully and unlawfully destroyed a document issued under the seal of the Magistrate's Court Registrar.

In the Police Court he dismissed two charges against Clarence Miller, 35, fumigator, of Cribb Street, Milton. Miller had pleaded not guilty to charges that he assaulted Clive Gallagher, deputy bailiff of the Magistrate's Court, engaged in the lawful execution of a Court process on May 6, and unlawfully retained a utility truck after it was seized. Gallagher claimed in evidence that Miller knocked him down when he served a warrant on Miller at the Regatta Hotel, Toowong. Evidence was given that the warrant had been issued as a judgment against Miller for an £85 debt. Sub-Inspector Nesbitt said today that no further evidence would be offered. Mr. E. Duncan (for Miller) renewed an application for dismissal of the charges. Mr. Mansell accepted Mr. Duncan's submission that no case had been established. " From the evidence, no jury would convict," said Mr. Mansell.

Brisbane Telegraph (Qld. : 1948 - 1954), Wed 28 May 1952, Page 8 PUNCHED BY TRUCK DRIVER - BAILIFF ALLEGES The Deputy Bailiff of the Magistrate's Court (Clive Gallagher) alleged he was assaulted by a man whose utility truck he attempted to seize under a Court warrant, a detective told the Police Court today. The owner of the utility, Clarence Miller, 35, denied a summons charge that he unlawfully assaulted Gallagher while he was engaged in the lawful execution of a process of the Magistrate's Court on May 6. Miller also denied a charge that he unlawfully kept the utility after it was seized. The detective, Sergeant Frank White, of the C.I.B., said he was called to the Regatta Hotel and saw Gallagher outside with blood on his nose and a mark above his lip. He saw Miller in the bar of the hotel and told him Gallagher alleged he had been assaulted. Miller said he had never seen Gallagher. Took warrant White said he called Gallagher. Gallagher said he had approached Miller at the hotel and showed him the warrant. He intended to seize the truck which was in the back yard of the hotel. Miller seized the warrant and walked away. White said Miller said he had torn up the warrant and thrown it away. Gallagher said he told Miller he was going for police assistance. Miller asked him not to ring the police but to go outside and talk it over. They walked outside and Miller assaulted him, said Gallagher. Soon afterwards he found the truck missing. Held up warrant White said he took Miller to the C.I.B. There he said Gallagher had told him that he (Gallagher) had seen Miller about the warrant previously, but he did not execute it when Miller told him he wanted to go to Ipswich and promised to see him the following day. White said Miller told him it was not Gallagher who showed him the warrant but a younger man. He claimed he did not see the man the next day because he did not get back from Ipswich. White said Miller told him the warrant was issued out of the Magistrate's Court as a result of a judgment against him for a debt of £85, which he was alleged to have owed to a man named Rice. But Miller said he did not owe Rice that much and Rice owed him money, too. White said Miller told him a footballer whose name he did not know had borrowed the truck from him the afternoon of the alleged assault and he did not know where it was then. The case was adjourned until tomorrow. Mr.. Mansell. S.M.. was on the bench. Sub-Inspector Nesbitt prosecuted and Mr. E. Duncan appeared for Miller.

MANSELL, S.M., yesterday refused a barrister's application that charges against Clarence Miller, 35, fumigator, should be struck out. He told the barrister. Mr. E. Duncan, in the Police Court, he could renew his application after the Magistrate's Court Deputy Bailiff Clive Gallagher — who had laid the charges— had given evidence. Mr. Duncan had submitted at the previous day's hearing that the charges were null and void because a court document had been altered. Miller, of Cribb Street, Milton, is contesting a summons charge of having assaulted Gallagher while Gallagher was engaged in the lawful execution of a process of the Magistrate's Court. Motor claim He is also contesting a charge of having retained a utility while it was in Galagher's custody, with intent to defeat an attachment. Gallagher, of Edmonstone Street, South Brisbane, alleged yesterday that Miller had assaulted him after he had seized a utility truck from him under a warrant of execution, at the Regatta Hotel on May 6. He said Miller knocked him down three times. Hearing was adjourned until June 19.
