Herbert was born in 1846. He was the son of Alan Legge Gardner, 3rd Baron Gardner of Uttoxeter and Julia Sarah Hayfield Fortescue.
He was educated at Harrow and at Trinity Hall, Cambridge. At Cambridge, he was a member and eventually manager of the Amateur Dramatic Club which was 'flourishing exceedingly' under his management.
He graduated from Trinity College, Cambridge University, Cambridge, in 1872 with a Master of Arts (M.A.).
Herbert held the office of Member of Parliament (M.P.) (Liberal) for North Essex between 1885 and 1895.
He married Lady Winifred Anne Henrietta Christiana Herbert (daughter of Henry Howard Molyneux Herbert, 4th Earl of Carnarvon and Lady Evelyn Stanhope) on 4 March 1890 at St. Peter's Church, Brighton, Sussex, England.[1]
He held the office of President of the Board of Agriculture between 1892 and 1895, was appointed Privy Counsellor (P.C.) on 25 August 1892 and he was created 1st Baron Burghclere of Walden, Essex [U.K.] on 3 August 1895.
He passed away in 1921at the age of 74. As he had no sons the barony became extinct upon his death.[2]
