Biography

Joseph was born in about 1786. He married Sarah Stroud on 8 Sep 1810 in Burke County, North Carolina.[1] He passed away in 1873 and is buried at Pisgah Church of Christ Cemetery in Ellijay, Gilmer County, Georgia.[2]

Witness; Zackariah Hawkins; Thos Green. Executed 23 Mar 1835. Described 2 tracts of land; 274 & 500 acres.[4]

Research Notes

Who were the parents of Joseph Garrett?

  1. William Garrett and Elizabeth Turner: It's proposed that his parents were William Garrett and Elizabeth Turner. However, some researchers associate him with one of several William Garretts in South Carolina as well as William Garretts in Delaware, Pennsylvania, and even Tennessee. Conflation is an issue.
    • The above land deed for Joseph Garrett, from his deceased father-in-law, lists a William Garrett owning land adjoining Peter Stroud Jr. There was a William Garrett 45+ on the 1820 Census in Burke County. He was listed next to John Garrett (16-25). Could this William be Joseph's father? Where was Joseph? I suspect this has prompted folks to assume Joseph and John were the same person. But, records don't support that. See below.

  2. John Garrett and wife Yeatman: A DAR submission exists that implies Joseph Garrett, who married Sarah Stroud, was born in 1767 and was the son of John Garrett of Delaware. Given the discrepancies and other issues, the DAR supporting documentation needs to be reviewed for the Joseph Garrett claim to determine if an error should be reported and/or a supplemental application should be submitted.     • The claim is through Robert Garrett son of Joseph Garrett and Sarah Stroud. The claim indicates that Joseph was born in 1767 in DE. The 1870 Census contradicts this claim. Fortunately, Joseph was living with his son Robert in 1870. And the Census indicates Joseph was born in 1784 in SC. This information is not even close to the claim of 1767 in DE. Clearly an error on the DAR application.
    • Age of Joseph Garrett of Gilmer Co GA, who died in 1873 in GA.
      • 1850 Census born about 1786 in SC.
      • 1860 Census born about 1785 in NC.
      • 1870 Census born about 1784 in SC. Joseph was living in Gilmer Co GA with son Robert Garrett. Again, the DAR claim via Robert Garrett attempts to link to a man named Joseph Garrett, born 1767 in Delaware. For this to be true, Joseph would have been enumerated as being 103+ years old and born in DE. The 1870 Census alone contradicts the DAR lineage claim.

  3. Samuel Garrett or Daniel Garrett: Samuel Garrett, possible relation, was a documented landowner on Muddy Creek as early as 1778. William Garrett paid taxes for land on Muddy Creek in 1815. There are other records in Burke County, North Carolina. In 1820 William Garrett, age 45+ (born before 1775), was enumerated on U.S. Census. He was listed next to John Garrett age 16-25. In 1823, William Garrett, John Garrett, and Robert Garrett were bondsmen for a bastardly bond. In 1826, "William Garrett Senr" was a chain carrier for John Garrett's land grant, which adjoined Dilly Stroud. In 1835, in the disposition of land inherited by Joseph Garrett and Sarah Stroud-Garrett from Peter Stroud, Jr. dec'd, it states the land adjoins William Garrett. Who was John Garrett of Burke Co, NC? Frequently I see Joseph listed as 'Joseph John Garrett' in other trees. However, Joseph Garrett (d:1873) cannot be the same person as John Garrett (d:1835). John Garrett, listed on the 1820 Census in Burke Co, NC, is likely the same John Garrett who was convicted of murdering Peter Stroud, Jr. John Garrett was identified as a son-in-law of Peter Stroud, Jr. He was sentenced to be hanged on 11 Dec 1835. See Peter's profile as well as FamilySearch Person Memories: LDTZ-R2V. Contrary, Joseph Garrett is listed numerous times on the estate sales list for Peter Stroud, Jr. Additionally, Joseph Garrett was involved in a land transaction for inheritance. Certainly, a man convicted of murdering Peter would not have been involved in, or benefited from, the estate of Peter. Finally, Joseph Garrett died in 1873. Raffety-49 14:00, 13 April 2022 (UTC)

What if? Was John Garrett the brother of Joseph Garrett and William 'Old Billy' Garrett? How were they related? Was Dillia Garrett the wife of John Garrett and daughter of Peter Stroud, Jr.? Was she the same person as Dilly Stroud, who owned land next to John Garrett?
