Biography

John Garth was the son of Thomas Garth and Judith Bocock. He was born on the 15th of August 1762 in Albemarle, Virginia.

John Garth died on the 9th of November 1835 in Scott County, Kentucky. WILL: The following is a transcription from the copies of the original document made by Judith Weeks Ancell on December 16, 1992. "Know All men by these presents that I John Garth of the County of Scott and State of Kentucky being in my proper mind but knowing that life is very uncertain have this 4th day of July in the year 1833 made and published and by these presents do make constitute ordain and publish the following as my last will and Testament. I Will and bequeath unto my Son Daniel Garth in addition to what I have already given him the Sum of Five hundred dollars to be paid as hereafter named I Will and bequeath unto my Son Samuel Garth in addition to what I have already given him the Sum of Eight hundred dollars to be paid herein after provided for I Will unto my daughter Quintella Otwell One Thousand dollars to be paid as herein provided for I will unto my daughter Milly Sutfield one thousand dollars to be paid to her as here in after provided for I Will unto my daughter Lucinda Graves one thousand dollars to be paid as herein provided for I Will unto my daughter Nancy Buckhannan One Thousand dollars to be paid as herein after provided for. I will unto my daughter Sarah Garth one Thousand dollars to be paid her as herein after named I Will unto the children of Judith Garth my daughter the sum of Seven hundred dollars to be equally divided amongst them and to be paid as herein after provided for I Will unto my Son Jefferson Garth in addition to what I have already given him the amount which he is now in my debt which is five hundred dollars more or less That is I do not Will him to be paid this amount of money but I accept Release and discharge him from the payment of said Sum which he owes me as aforesaid I Will and bequeath unto my Son John Garth the tract of Land and Appurtenances upon which he now lives during the natural life time of the said John Garth and his present wife and after their death I Will said farm to the children of said John Garth or their heir in fee Simple of the said John Shall have any such at his death but if he has not-Then I Will said farm after the death of said John and his wife to my right heirs in fee simple I Will and Direct that at My death out of my Money and Debts that my debts by me being if any should be paid- The balance of money upon hand or debts due me When collected I direct shall be paid ove pro Rata as payment and discharge of the money legacies herein before named and bequeathed__The balance of said legacies in money which shall remain unpaid by the means above provided in their payment and by me during their life time I Will and direct Shall be paid by my Son Albert Gallatin Garth and for his true performance thereof and to Secure the payment of said Sums directed to be by him paid I hereby Charge All the estate herein after to him Willed with the payment thereof and the said estate to him herein Willed Shall be bound and liable for the payment of said Amounts directed to be paid by him as aforesaid upon his failure to doing the Same written the lines herein before named At my death I Will and bequeath unto my Son Albert G Garth the farm upon which I now live and his heirs forever I Further at my death Will unto my son A G Garth the use benefit and entire profit of all my Negros of All my Stock household and Kitchen furniture Crop on hand and of all my personal estate whatever of every Kind and description except Money on hand and debts Due on the term of Five years During which time my said Son with Industry will be able to make enough to pay off and discharge Said legacies aforesaid At the end of said term of Five years I Will and direct that my Negros and Remaining personal Estate of every kind shall be divided in two equal Moreties(?) due of which I will and devise to my said Son Albert G Garth and his heirs forever The other Mority(?) or half of my Negros and my personal estate above named together with ten Shares of Stock in the RailRoad Which said Stock I have not intended to dispose of heretofore by any exception or desire herein I Will to be divided into twelve equal Shares or parts One of which Shares I will unto Daniel Garth and his heirs forever One I Will unto Samuel Garth and his heirs forever One I Will unto Quintilla Otwell and her heirs forever_One I Will unto Milly Sutfield and her heirs forever_One I Will unto Lucinda Graves and her heirs forever One I Will unto Nancy Buckhannon and her heirs forever One I will unto Sarah Garth and her heirs forever One I will unto John Garth and his heirs forever One I will unto Jefferson Garth and his heirs forever_One I Will equally to the children of my daughter Judith Garth to them and their heirs forever One I Will onto Rodes Garth to him and his heirs forever_And One I Will unto Thomas Garth to him and his heirs forever_I Will and direct that my wife should she out live me shall live upon the farm---to Albert G Garth in the Mansion house with the aid Albert G Garth during her natural lifetime and that my said Wife Shall be decently and amply Supported taken care of and provided for by my Said Son A G Garth during the natural life of my said wife-To Secure which I also charge with the Same and Direct that it Shall Stand Bound therefore the farm by me willed to the said Albert G. Garth_ I Hereby nominate and Appoint my Sons David Garth Jefferson Garth and Albert Garth with James F Robinson Executors of this my Will Signed Sealed and published the day and date just written John Garth (his seal)" Attest Ben B Ford H Rankinst "Scott County jul December 7, 1835 The foregoing last Will and Testament of Joh Garth decd. was this day was produced in court and was proven by the Oath of Ben B Ford one of the Subscribing witnesses thereto Who also made Oath to the attestation of H Rankins to the other Subscribing Witness in his presence and said Will is ordered to be Recd Attest Ben B Ford Clk" "Scott County jul September Court 1837 Satisfactory Evidence being produced in Court that the Final Will and Record of the same of John Garth decd was destroyed_And Albert G Garth one of the Executors produced in Court a certified Copy of the same it is ordered to be Recorded by Virtue Thereof the Same is duly Recorded together with the certificates hath been duly Recorded"

I think we are missing this Thomas Garth, father of William Garth 1815-1859(60?), for whom I have found lengthy biographical sketch that includes his will and census record 1850.

And he appears in your own source on rootsweb, but strangely not in the will:

"Thomas, born about 1792 in Scott County, Kentucky. Thomas married first Lester Nancy Thompson/Thomson. She was born on February 19, 1796 in Kentucky and died on October 21, 1881, Boone County, Kentucky. One son, William. Marriage ended in divorce. Thomas married second on November 4, 1826 to Joanna Lucas. She was born 1806 or 1808 and died January 17, 1881. Thomas died April 20, 1840, he and Joanna are buried in Paris City Cemetery in Bourbon County, Kentucky".

Garth-17 and Garth-133 appear to represent the same person because: Garth-17 and Garth-133 are the same individual. Garth-133 should be merged into Garth-17. Samuel Garth and Jefferson Garth are sons.
