Notes

Note N3371
*****************************************************
1820 census: There are two other Gregorys in Rutherford county who could be his oldest son: Edward and Alexander. Alexander is also found in 1810, so he is not likely to be John's son. In addition, he got married in April 1810 in Rutherford, and the 1810 census was taken in August. Edward is a name found in the Union County SC Gregorys. John Gregory had a son named Edward (brother to John Wesley). He is found in Union, SC in 1810, so it is not the same person.
Edward Gregory age 26-44 found on p. 175. He is 50-59 in 1830, so too old to be John's son.
John found on p. 145

Whereupon I have truly recorded the same & this Certificate in my said office. Given under my hand this 12th day of October 1839. Jas. L. Dallam."
"John Gregory & Mrs. Rebecca Brookshire had married the 3rd of April 1838 in Livingston County, Kentucky. Performed by W.C. Lowe---marriage bondsman, Martin Hammond."----researched by Marvin & Bonnie Ezell Snoddy.
Court Records---"June 3, 1846--James Cannon, & wife, Rody, (my note--Rhoda Gregory, daughter of John Gregory) of Crittenden County, Kentucky, mortgage to Asa Stone (my note--husband of Rebecca Gregory, daughter of John Gregory) of Green County, Illinois, all their interest & claim to the estate of John Gregory, deceased---Cannons being heirs of Gregory. Cannon owes Stone a note for .44, with 6% interest. If the debt is paid, this transaction is void. Witnesses---John D. Gregory (my note--son of John Gregory, deceased)--Asa S. Lee (my note--son of Sarah( Gregory) Lee, daughter of John Gregory)---Rody Cannon relinquished right of dower--recorded June 11, 1846"
"June 25, 1846, Rachel Gregory (3rd wife of John Gregory, & widow of same--my note) appoints Elihu R. Lacey as an attorney, to ask, demand & receive all sums of money which are due her from the estate of John Gregory." (my note--Rachel had first been the widow of a John Lacey, before she married John Gregory---is Elihu Lacey, the attorney, her son?)---my note---evidently, some of the kids of John Gregory were protesting his unrecorded will, & she fought back.
"Court Order Book 1, page 139, July 13, 1846--On order of John D. Gregory, Silas H. Stone, Asa Stone, Greenbury Jacobs, & James Cannon, it is ordered that William Hogard, W.B.Rice, Charles Lizenbee, James Shewmaker, & James Duvall be appointed commissioners to allot the dower of Rachel Gregory in & to the lands that were the property of John Gregory, deceased, & of whom Rachel is the widow & relict."
"April 13, 1847--Thomas Lee mortgaged to Asa S. Lee & James Cannon (my note--Thomas Lee`s son, & brother-in-law; Thomas`s wife, Sarah (Gregory) Lee, died in 1845) all of Crittenden County, Kentucky, his undivided one eighth interest in the landed estate of John Gregory, deceased. Asa S. Lee & James Cannon have this day replivined for Thomas Lee, a debt of .16, the amount of an exzecution which issued from the office of J.W. Headley in favor of David L. Stephenson & against Thomas Lee. If Thomas Lee discharges the debt in the repliven bond, Asa S. Lee & James Cannon are relieved from paying the debt, this conveyance will be void."
"May 26, 1847--James Cannon & wife, Rhoda, of Pike County, Illinois, to Asa Stone of Green County, Illinois, 0 for two tracts of land being the undivided 8th part of all the real estate of John Gregory, deceased, in Crittenden County, Kentucky. Witnesses---Andrew J. Stone; J.R. Cleveland; Rhoda Cannon released right of dower---Pike County, Illinois; May 26, 1847; recorded Crittenden County, Kentucky, August 3, 1847."
Unrecorded Will of John Gregory dated 15 July 1843;
"I, John Gregory...in perfect health...being desirous to settle my worldly affairs & thereby be better prepared to leave this world...after my debts are paid, I give, bequeath & devise unto my beloved wife Rachel, all of my property but she is not to sell or dispose of any of the land or negroes or hire any of the negroes out of the county. I have already advanced 0 to my son John D. Gregory & expect to be subjected to about 0 costs through his instrumentality which will make 0. I have advanced to Greenbury Jacobs who married my daughter Rachel, 0. I have already advanced 8 to Jonathan Duncan, who married my daughter Elizabeth. I have already advanced to Thomas Lee, who married my daughter Sally, 0 & I furthurmore expect to be subjected to an expense of through his agency. I have advanced Silas Stone, who married my daughter Miriam, 2 & also expect to be subjected to an expense by him of . But to son Robert Gregory & Asa Stone, who married my daughter Rebecca, & to James Cannon, who married my daughter Rhoda, I have made no advancements. Wishing all children to stand upon equal footing...I hereby direct that out of such property as my wife shall leave at her death or as she shall possess at the time of her marriage, should she again marry, advancements shall first be made to all of my children equal to the amount of 0...Should anything be left. I wish & direct it to be equally divided among all my children...Should the property my wife may have at her marriage or leave at her death not be sufficient to make the advancements...I wish advancements made to Robert Gregory, Asa Stone, & James Cannon until they shall be equal to those of my children who have already received advancements. Constitute & appoint whoever may be the High Sheriff of Crittenden County at the time of my death the execution of my last will & testament. John Gregory----Witnesses: William B. Hickman; Will J. Dallam; S. Marble"
Filed in open court 12 January 1846 for probate & continued for proof. Feruary term 1846...Witnesses all examined for & against Will & this writing by court rejected as John Gregory`s last Will & Testament. H.W. Bigham, clerk
Court Order Book 1, page 139, 13 July 1846
On order of John D. Gregory, Silas H. Stone, Asa Stone, Greenbury Jacobs & James Cannon, it is ordered that William Hogard, W.B. Rice, Charles Lizenbee, James Shewmaker & James Duvall be appointed commissioners to allot the dower of Rachel Gregory in & to the lands that were the property of John Gregory, dec`d, & of whom Rachel is the widow & relict."
I think the reason the above Will was not recorded was John Gregory had just married Rachel Lacey, a widow, on March 22, 1843 & had written a new will just four months later. It seems that most of the children protested the will in court.
John Gregory had also married another widow, Mrs. Rebecca Brookshire, on April 3, 1838 & had divorced her in October of 1839." (research by Marvin & Bonnie Ezell Snoddy)
Notice that Thomas Lee, son-in-law of John Gregory, husband of Sarah (Gregory) Lee, did not protest this will, as his wife had died in 1845---also, they had received their allotment.
John Gregory is on the 1820 Rutherford County, Tenn. census; (Also on Rutherford County, Tenn. Census, is an Edward Gregory; & an Alexander Gregory---some relations to John? Anyone KNOW? Please write, if you know---thanks.

On 1800 there are two SC John Gregorys listed. One is in Union District, and is too old with too many children to be this John. Neither does he have a son the right age to be this John. The other is in Pendleton District, and matches up better, but is found there in 1810 as well. A "Janea" Gregory in Union matches up perfectly and is our guy.
