Biography

Nicholas Heale obtained 500 acres in Lancaster County in the Colony of Virginia on 1 June 1657 through purchase of one-half of the patent granted to Enoch Hawker on 29 July 1652, which had been purchased by Heale.[1] On 18 May 1666, he acquired headrights for an additional 238 acres of land in Lancaster County for transportation of five persons to the Colony of Virginia.[2] Identified as "Nicholas Hale," he obtained headrights for an additional 234 acres in Lancaster County on that same day for the transportation of an additional five persons.[3]

Nicholas' wife is identified by some researchers as Mary Travers.[4] Mary Hale was listed in the debts for the estate of Rawleigh Travers.[citation needed]

Nicholas died in Virginia before November 8, 1671 when records show Mary Haile as executrix for the estate of Nicholas Haile, her husband, deceased.He died intestate so only the administration of his estate is available.[citation needed]

Disputed Parents

He was previously attached as a child of George Haile and Mary Elizabeth Blood, with no source cited. They have been detached pending identification of a reliable source for his origins.

There were several early HAILE, HALE, HAYLE, HEALE settlers in Virginia. Some have claimed that Nicholas Haile was the son of a George Haile. This is questionable, since while there were some George Hale immigrants, notably a 13 year old drummer boy named George Hale on the ship Supply in 1620, and a George Hale/Heale in Northumberland County who claims to be over 60 years of age in 1661, it seems that records indicate that Nicholas Haile of Lancaster Co VA, was of York County until 1656 when he is described as of Lancaster Co. In the Records of Northumberland Co is a Thomas Haile, Hayles, Hale who seems to have been born ca. 1601, and may be the 20 year old Thomas Hale arriving on the GEORGE in 1623. The Thomas Haile appears in Northumberland Co records starting in 1648. He apparently had a son name John. What relation may exist between Nicholas Haile and these other Haile, Hale families that were living in the same area is unknown. [5]

Possible Emigration

A "Nicho. Hayle" was transported to the Colony of Virginia before 31 July 1645, when a headright was granted to Marke Johnson of Elizabeth City County on 31 July 1645 for his transportation.[6] It is possible that this is the record of the emigration of Nicholas Haile to Virginia. It is also possible that one of the other emigration records discussed in the "Conflation" section below is the record of his emigration.

Conflation with Others

A prior version of this profile the following:

His name as a "transportee" was used to acquire grants of land in early Virginia by at least three different persons. He had sufficient funds to purchase in 1652 an interest in a large tract of land which he patented in subsequent years. Nicholas also transported to Virginia at his own expense as many as a dozen bonded servants which he used to obtain land patents. [7]

This statement appears to assume that in addition to the references to Nicholas Heale and Nicholas Hale cited in the biography above, and the refernece to the "Nicho. Hayle" who was transported to Virginia by Marke Johnson before July 1645, the following additional references in Volume 1 of Nugent's Cavaliers and Pioneers also all refer to the same persion:

  • p. 1:272 - headright granted on 13 Jan 1652 to Capt. Francis Morgan & Ralph Green for 16 persons including "Nicho. Heale"
  • p. 280 - headright granted to John Maddison for 600 acres in Gloster County on 4 Jan 1653 for the transportation of 12 persons, including "Nicholas Hele"

It is more likely that these are different men with similar names who were all transported to Virginia. It is unclear which, if any, of these refer to the Nicholas Heale who obtained multiple land grants in Lancaster County.

Can anyone explain what the phrases "...committed his son ____ to the tuition of..."

and "... debts vs. ___ estate" would have meant back then?

1667/8 Jan 8: Before Robert Pollard, deceased, went to England he committed his son Robert Pollard to the tuition of Nicholas Hale and debts vs. Pollard Estate. Ref: The book "Virginia Colonial Abstracts - Series 2, Vol. 2 - Lancaster Co, Va.

I posted this today on Mary (Travers-20) . . . . There are a lot of questions around this Mary Travers-20. Was her surname really Travers. FamilySearch has this note: (Nicholas' wife was claimed to be Mary Travers. Mary Hale was listed in the debts for the estate of Rawleigh Travers.[citation needed]).

She has on this profile, 3 children indicated (2 of them were born before she was marr. to Nicholas Haile-24, in 1654. Nicholas Haile-24 shows 5 children with Mary (before they were married in 1654). This seems to indicate that Mary was marr. to a Rawleigh Travers, prior to marr. Nicholas Haile. It also seems to indicate that Nicholas was marr. to ?? prior to marr. Mary. Thoughts?? I have Nicholas Haile as Nicholas Heale, this information came from a Genealogist (could get name if needed). Nicholas Haile aka Heale had a son George Heale b. 1643 - 1649 d.1697 who then become Hale who had 9 children.

Nicholas Heale married Mary "May" Travers son of Rev. Rawleigh & Hannah Ball/Travers. Nicholas was a member of the House of Burgess 1663-1669.
